The septic system was all backed up,\u201d said <a href=\"https:\/\/www.homelight.com\/agents\/david-dorman-fl-00672825\">David Dorman<\/a>, a real estate agent in that area with 20 years of experience. What\u2019s more, the ex-wife thought to be living there had moved out and wouldn\u2019t cooperate with showings. \u201cIt got so bad that [the ex-husband] had to petition the court to give him sole custody of the property to maintain it.\u201d<\/p>\n<p>So much of our lives and our emotions are wrapped up in our homes that when divorce enters the picture, homeowners can damage one of their biggest assets while fighting over who should have done what\u2014or, as in this case, trying to get back at the other.<\/p>\n<p>While there are several divorce asset protection strategies, such as having a prenup, there\u2019s actually another that\u2019s relatively less costly in the short term: keeping the marital home in good standing so that both exes can reap its <a href=\"https:\/\/www.homelight.com\/blog\/selling-a-home-in-divorce\/\">maximum value upon a sale<\/a>.<\/p>\n<p>A house is one of the biggest assets that a married couple has\u2014and can provide a significant amount of money to each spouse once it\u2019s sold in a divorce. Research shows that Americans on average have <a href=\"https:\/\/www.urban.org\/research\/publication\/how-much-house-do-americans-really-own-measuring-americas-accessible-housing-wealth-geography-and-age\/view\/full_report\">$150,506 of wealth tied up in their homes<\/a>. (If you own your house free and clear with no outstanding debt, bump that <a href=\"https:\/\/www.urban.org\/research\/publication\/how-much-house-do-americans-really-own-measuring-americas-accessible-housing-wealth-geography-and-age\/view\/full_report\">average wealth nationwide to $229, 296<\/a>.)<\/p>\n<p>However, many people don\u2019t see that big picture amid the acrimony. \u201cI sell a couple of hundred homes a year that are foreclosed properties for banks and government, and a huge chunk of those are as a result of a divorce,\u201d said <a href=\"https:\/\/www.homelight.com\/agents\/tim-m-ray-mo-00049606\">Tim Ray<\/a>, a <a href=\"https:\/\/www.homelight.com\/kansas-city-mo\/top-real-estate-agents\">top agent in Kansas City, Missouri<\/a> who regularly helps <a href=\"https:\/\/www.homelight.com\/blog\/divorce-house-settlement-options\/\">divorcing couples sell their home<\/a>. \u201cPeople just throw their hands up because they don\u2019t know how to deal with their situation.\u201d<\/p>\n<p>Here\u2019s another way to protect your house in a divorce\u2014or rather, its overall value.<\/p>\n<figure id=\"attachment_12397\" aria-describedby=\"caption-attachment-12397\" style=\"width: 700px\" class=\"wp-caption alignleft\"><a href=\"https:\/\/www.homelight.com\/blog\/wp-content\/uploads\/2019\/09\/divorce-asset-protection-strategies-card.jpg\" target=\"_blank\"><img decoding=\"async\" width=\"700\" height=\"400\" src=\"https:\/\/www.homelight.com\/blog\/wp-content\/uploads\/2019\/09\/divorce-asset-protection-strategies-card.jpg\" class=\"attachment-content size-content\" alt=\"\" srcset=\"https:\/\/www.homelight.com\/blog\/wp-content\/uploads\/2019\/09\/divorce-asset-protection-strategies-card.jpg 700w, https:\/\/www.homelight.com\/blog\/wp-content\/uploads\/2019\/09\/divorce-asset-protection-strategies-card-64x37.jpg 64w, https:\/\/www.homelight.com\/blog\/wp-content\/uploads\/2019\/09\/divorce-asset-protection-strategies-card-128x73.jpg 128w, https:\/\/www.homelight.com\/blog\/wp-content\/uploads\/2019\/09\/divorce-asset-protection-strategies-card-192x110.jpg 192w, https:\/\/www.homelight.com\/blog\/wp-content\/uploads\/2019\/09\/divorce-asset-protection-strategies-card-432x247.jpg 432w, https:\/\/www.homelight.com\/blog\/wp-content\/uploads\/2019\/09\/divorce-asset-protection-strategies-card-500x286.jpg 500w\" sizes=\"(max-width: 700px) 100vw, 700px\" \/><\/a><figcaption id=\"caption-attachment-12397\" class=\"wp-caption-text\">Source: (rupixen\/ Unsplash)<\/figcaption><\/figure>\n<h2>Keep up with the mortgage payments<\/h2>\n<p>Lenders say that divorce is one of the top five personal scenarios\u2014life events beyond negative equity and rising interest rates\u2014that <a href=\"https:\/\/www.citywidehomeloans.com\/common-causes-foreclosure\/\">can lead to foreclosure<\/a>. Commonly referred to as \u201cthe five D\u2019s,\u201d they also include a death in the family, drugs or alcohol dependence, disease leading to unexpected medical bills, and the denial of a lifestyle that can\u2019t keep up with mortgage payments.<\/p>\n<p>Yet even if a divorced couple avoids foreclosure, they may get less out of a home sale than they\u2019d like. <a href=\"https:\/\/divorceandyourmoney.com\/\">Shawn Leamon<\/a>, a certified divorce financial analyst in Dallas, Texas, who hosts the popular podcast \u201c<a href=\"https:\/\/divorceandyourmoney.com\/our-podcast\/\">Divorce and Your Money<\/a>,\u201d said he\u2019s seen several <a href=\"https:\/\/www.homelight.com\/blog\/short-sale-should-you-do-it\/\">short sales<\/a> where lenders agree to let divorced couples sell their homes for less than they owe on the mortgage <a href=\"https:\/\/www.homelight.com\/blog\/how-do-you-do-a-short-sale\/\">in lieu of foreclosure<\/a> because of ignored payments or maintenance.<\/p>\n<p>An ex who wants to keep the property likely will <a href=\"https:\/\/www.homelight.com\/blog\/refinance-house-after-divorce\/\">refinance to qualify for a mortgage with his or her sole income<\/a> and buy out the spouse\u2019s share of equity. However, sometimes a couple wants to sell the house outright, resulting in either \u201c<a href=\"https:\/\/www.citywidehomeloans.com\/common-causes-foreclosure\/\">impaired communication<\/a>\u201d over who should pay the mortgage, emotional and financial stress related to this, or one party ignoring the payments out of spite.<\/p>\n<p>That was part of the issue with the scenario that Dorman recalled above. \u201cShe wasn\u2019t paying the mortgage,\u201d he said. \u201cHe\u2019s the one that\u2019s still on the deed, on the [promissory] note. So he had to step in and petition the court to give him some control over the property so that he could keep it from going into disarray.\u201d<\/p>\n<p>The ex-husband has taken the home off the market. \u201cHe\u2019s fixing it up, and hopefully, we\u2019re going to have it back in several months when he can fix all the finances with it too,\u201d Dorman said.<\/p>\n<p>A divorce agreement doesn\u2019t legally change the terms of your original mortgage, according to Lynnette Khalfani-Cox, personal finance expert at <a href=\"https:\/\/askthemoneycoach.com\/2010\/09\/im-going-through-a-divorce-weve-closed-joint-accounts-but-still-have-a-mortgage-together-im-moving-out-and-hes-keeping-the-house-the-bank-will-remove-my-name-onc\/\">AskTheMoneyCoach.com<\/a> and author of <a href=\"https:\/\/www.amazon.com\/Zero-Debt-Ultimate-Financial-Freedom\/dp\/1932450807\"><i>Zero Debt: The Ultimate Guide to Financial Freedom<\/i><\/a><i>. <\/i>If both people co-signed for the house, credit cards, a car loan, or any other debt, creditors can legally pursue either for repayment.<\/p>\n<p>Selling the home is the best way to protect the credit rating of both parties because your joint obligation is satisfied, Khalfani-Cox notes. Until then, so that you\u2019re not just crossing your fingers that your ex pays the mortgage as agreed, she suggests talking with your divorce attorney to include in your divorce agreement a <a href=\"https:\/\/family.findlaw.com\/divorce\/sample-form-property-settlement-agreement.html\">Property Settlement Agreement<\/a> (PSA), which addresses several aspects related to the house. For instance:<\/p>\n<ul>\n<li>\u00a0Noting your ex is <a href=\"https:\/\/askthemoneycoach.com\/2010\/09\/im-going-through-a-divorce-weve-closed-joint-accounts-but-still-have-a-mortgage-together-im-moving-out-and-hes-keeping-the-house-the-bank-will-remove-my-name-onc\/\">assuming full ownership and liability<\/a> of the home, including an effective date for the property taxes.<\/li>\n<li>\u00a0A clause indicating that until the divorce is finalized, the mortgage company is to provide you with a copy of the monthly statements so you can monitor the payments.<\/li>\n<li>\u00a0Any financial penalties and consequences to be imposed in the event of a missed payment, such as a cash payment to you. An attorney also can indicate that any failure on your ex\u2019s part to pay the mortgage effectively amounts to a judgment in your favor.<\/li>\n<\/ul>\n<h2>Maintain the property and complete necessary repairs<\/h2>\n<p>The state of your house can be indicative of what\u2019s happening in the rest of your life. If your marriage isn\u2019t going well, that\u2019s reflected in your house, Leamon said. \u201cDivorce usually is many years in the making. I\u2019ve seen plenty of cases where the house doesn\u2019t get taken care of for years. It just compounds,\u201d he said.<\/p>\n<p>Disrepair isn\u2019t solely a matter of bitterness. Sometimes it\u2019s financially or emotionally overwhelming to perform the upkeep. \u201cI\u2019ve seen that happen before where the person who ends up living in the house either can\u2019t afford to maintain it, or they just don\u2019t care to maintain it,\u201d said Dorman. \u201cIt ends up costing everyone money in the very end. The house sells for less because everybody is looking at the <a href=\"https:\/\/www.homelight.com\/blog\/home-maintenance-inspection\/\">deferred maintenance<\/a>.\u201d<\/p>\n<p>Again, you can speak to your ex or your divorce attorney about what\u2019s needed to get the house in order and extract a good selling price. A <a href=\"https:\/\/www.legalzoom.com\/articles\/what-is-a-final-divorce-decree\">divorce decree<\/a> or even a <a href=\"https:\/\/www.lawdepot.com\/contracts\/separation-agreement\/?loc=US#.XWgJaShKjBU\">separation agreement<\/a> can be so detailed as to discuss who is responsible for <a href=\"https:\/\/www.homelight.com\/blog\/how-to-sell-a-house-that-needs-work\/\">home repairs<\/a> and how to get approval for those costs.<\/p>\n<p><a href=\"https:\/\/www.homelight.com\/agents\/stacey-wyatt-ga-337187\">Stacey Wyatt<\/a>, a <a href=\"https:\/\/www.homelight.com\/roswell-ga\/top-real-estate-agents\">top-selling agent in the Atlanta area<\/a>, worked with one couple who had been separated for at least a year. So even if you and your estranged spouse are somewhat amicable, trust that you\u2019ll need third parties such as a divorce attorney, a real estate attorney, a real estate agent, or a financial planner to guide you through the particulars.<\/p>\n<p>&#8220;Divorce is not a DIY project,\u201d Dorman said.<\/p>\n<blockquote><p>\u201cYou need an unbiased person to be realistic and help you sort things out before it gets uglier than it has to.\u201d<\/p><\/blockquote>\n<p>These experts can assist you with the \u201cmillion different what-ifs that you\u2019re trying to juggle,\u201d Leamon added. \u201cI have zero emotions about the situation. Unfortunately, it\u2019s their whole lives.\u201d<\/p>\n<p>Experts like these will focus on your financial best interests because of their specialties. They can counsel you about how your immediate feelings could impact your finances down the line.<\/p>\n<p>How do we get you through this situation so you can make the smartest decisions you can, so you don\u2019t look back and say, \u2018I should\u2019ve done this differently?\u2019\u201d Leamon said. \u201cIt\u2019s complicated, but it\u2019s not hard. If you take the time to educate yourself, you go through the process a lot more informed \u2026 so you can move on in a happier healthier way.\u201d<\/p>\n<p>The quickest and best way for both of you to get the most equity out of the house is to sell it, Dorman said. \u201cTo make that happen, there needs to be a higher level of compromise, usually from one person than the other, which is unfortunate. But sometimes you have to put your emotions aside and realize that if you don\u2019t\u2014if you dig in your heels\u2014just because you feel that you\u2019re right, you could end up taking a lot longer to sell your home. There\u2019s a saying I used just the other day: \u2018Just because you\u2019re right doesn\u2019t mean you have to be right.\u2019\u201d<\/p>\n<p>As you work through this difficult part of your life, try to view your house not as a place solely of treasured memories but as the financial asset it\u2019s always been.
