That may work in the movies, but in reality, real estate inherited via a will is usually subject to the <a href=\"https:\/\/www.homelight.com\/blog\/probate-timeline\/\">long, complex probate process<\/a>.<\/p>\n<p>And if your parents didn\u2019t leave a will, then probate is pretty much a given.<\/p>\n<p>So, <a href=\"https:\/\/www.homelight.com\/blog\/probate-inheritance\/\">what is probate<\/a>?<\/p>\n<p>Probate is a court-supervised process that oversees the dispensation of your parents\u2019 entire estate, including the sale of the house. This is done so that the proper people are granted the right to and responsibility for the estate and so that your parents\u2019 debts are paid as part of the process.<\/p>\n<p>While <a href=\"https:\/\/www.findlaw.com\/estate\/planning-an-estate\/state-laws-estates-probate.html\">probate laws vary from state to state<\/a>, expect the complex process to take a while, from several months up to a year or two.<\/p>\n<p>Depending on the laws in the state where your home is located, the courts may play a role in when and <a href=\"https:\/\/www.homelight.com\/blog\/buyer-what-is-a-probate-sale\/\">how the home is sold during probate<\/a>. So be sure to do your <a href=\"https:\/\/www.homelight.com\/blog\/selling-advice\/inheritance\/\">probate research<\/a> and enlist the help of a probate attorney.<\/p>\n<h3>Transfer on death deed<\/h3>\n<p>There is one way for the ownership of your deceased parents\u2019 home to transfer to you as easily as it does in the movies: the <a href=\"https:\/\/definitions.uslegal.com\/t\/transfer-on-death-deed\/\">transfer on death deed<\/a>.<\/p>\n<p>Also known as a <a href=\"https:\/\/definitions.uslegal.com\/b\/beneficiary-deed\/\">beneficiary deed<\/a>, this type of deed lets you inherit the property directly and immediately without the time, hassle, and expense of probate. With this type of deed in place, you can proceed with the sale of your parents\u2019 home as soon as you\u2019re ready.<\/p>\n<p>However, this deed type is <a href=\"https:\/\/trustandwill.com\/learn\/beneficiary-deed-states\">only valid in certain states<\/a>. The laws governing these deeds vary from state to state, too.<\/p>\n<p>For example, in some states, all you need is a completed transfer on death deed to avoid probate. In other states, your parents must also bequeath the property to you in their validated will, or the transfer on death deed is rendered meaningless.<\/p>\n<p>Finally, while you can avoid probate with a transfer on death deed, you will still need to pay taxes on the house when you inherit it this way (more on this topic later).<\/p>\n<h3>Living trust<\/h3>\n<p>It\u2019s much simpler to sell your parents\u2019 house if you\u2019ve inherited it via a <a href=\"https:\/\/www.legalzoom.com\/articles\/what-is-a-living-trust\">living trust<\/a>.<\/p>\n<p>A living trust is a document designed to streamline the management and inheritance of all of your parents\u2019 assets \u2014 including the house. The document names your parents as the trustees (allowing them to manage all assets while they are still living), and you as the beneficiary.<\/p>\n<p><span style=\"font-weight: 400;\">If you inherit property where there\u2019s a living trust in place, you can bypass probate and avoid some estate taxes.
