So, let\u2019s lift the curtain, shall we?<\/p>\n<p>We spoke with top real estate agents and an expert auctioneer in an effort to not only clear up the questions surrounding foreclosure auctions but also see if there\u2019s a way to capitalize on the process. Buying a foreclosed home at auction can be a great way to get an excellent deal on a house, but foreclosures can also be riddled with hassles and problems. Homes go into foreclosure for a variety of reasons, including job loss, medical issues, or divorce. When a homeowner fails to pay for several months, the bank will serve a <a href=\"https:\/\/www.investopedia.com\/terms\/n\/notice-of-default.asp\">notice of default<\/a> and enter into foreclosure proceedings.<\/p>\n<p>The foreclosure process varies from state to state, but there is always a <a href=\"https:\/\/www.thebalance.com\/definition-of-equity-of-redemption-2866606\">redemption period<\/a> in which homeowners have the right to retain ownership by satisfying all payments and interest. If they do not, the property moves into the hands of a bank-appointed trustee and may then move onto the auction block.<\/p>\n<h3>What is a foreclosure auction?<\/h3>\n<p>Approximately <a href=\"https:\/\/www.realtytrac.com\/statsandtrends\/foreclosuretrends\/\">40% of foreclosed properties go up for auction<\/a>. Much like a traditional auction, a foreclosure auction allows potential buyers to bid on the bank-seized property. These auctions can be conducted <a href=\"https:\/\/www.auction.com\/blog\/buying-foreclosures-at-auction-the-basics\/\">in person<\/a> (either at the actual site or in a public building) or <a href=\"https:\/\/www.auction.com\/blog\/buying-foreclosures-at-auction-the-basics\/\">online<\/a>. For that reason, auction-goers should look up the auctioning entity \u2014 whether it\u2019s an auction house or real estate brokerage firm \u2014 on that state\u2019s department of licensing website. Each state\u2019s department name is slightly different, but a quick search of \u201cauctioneer licensing in [state]\u201d will bring up the governing body in your state.<\/p>\n<p>Bottom line: you\u2019re looking for verification that the auctioneer is qualified, licensed, and has no outstanding complaints. This is especially important when focusing on foreclosure auctions, due to the extra level of care needed when dealing with the state regulations of redemption periods.<\/p>\n<p>Debbie Shuler, an expert real estate auctioneer at <a href=\"https:\/\/www.soldfor.com\/\">Cliff Shuler Auctioneers &amp; Liquidators<\/a> with more than forty years of experience in Florida, cautions bidders to do their due diligence in terms of research. She says, \u201cUnder the laws of real estate, auction is one of the services that can be performed by a real estate brokerage firm. However, that doesn\u2019t mean they know what they are doing \u2014 so check them out.\u201d<\/p>\n<h3>Understand the requirements before getting involved<\/h3>\n<p>Each auctioneer has a different set of rules, and you\u2019ll need to read them carefully. Look for the following:<\/p>\n<ul>\n<li><strong>Deposit fee.<\/strong> This refundable fee is required to register and will go toward your <a href=\"https:\/\/www.homelight.com\/blog\/how-to-protect-earnest-money\/\">earnest money<\/a> if you win. It proves you are serious about the bidding process.<\/li>\n<li><strong>Payment timing.<\/strong> Check when earnest money and full payment will be due.<\/li>\n<li><strong>Auctioneer\u2019s fee.<\/strong> Often auction houses charge a percentage of the final sale prices (<a href=\"https:\/\/www.auction.com\/blog\/buying-foreclosures-at-auction-the-basics\/\">around 5%<\/a>). For foreclosures, the bank may pay this fee.<\/li>\n<\/ul>\n<h3>Research your options<\/h3>\n<p>First you\u2019ll need to know what auctions are coming up, so watch those auction advertising outlets mentioned above. By looking ahead, you\u2019ll be able to have adequate time to research the home before it\u2019s time to bid.<\/p>\n<p>Shuler says<b>, <\/b><b>\u201c<\/b>Do your research on the property. Talk to the building department, zoning officials, tax assessor, etc. from the county. Know and understand what you are buying, what\u2019s included, and what the subdivision may require, along with the county and the city.\u201d Some things that you may want to ask include:<\/p>\n<ul>\n<li>Have improvements been <a href=\"https:\/\/www.nolo.com\/legal-encyclopedia\/home-improvement\/when-homeowners-must-obtain-permits-for-home-projects.html\">properly permitted<\/a>? If not, how can that be rectified?<\/li>\n<li>Are there any <a href=\"https:\/\/www.investopedia.com\/terms\/b\/back-taxes.asp\">back taxes<\/a> or tax liens on the property?<\/li>\n<li>Are there any HOA fees or assessments due?<\/li>\n<li>What are <a href=\"https:\/\/www.homelight.com\/blog\/hoa-documents\/\">the HOA bylaws<\/a> and <a href=\"https:\/\/www.nolo.com\/legal-encyclopedia\/what-the-difference-between-association-bylaws-ccrs-hoas.html\">CC&amp;Rs<\/a>?<\/li>\n<li>What are the zoning laws? (This is important if you plan to make additions to the property)<\/li>\n<\/ul>\n<p>You may or may not be able to <a href=\"https:\/\/www.homelight.com\/blog\/buyer-what-to-look-for-in-final-walkthrough\/\">walk through<\/a> the foreclosed home before bidding, and online pictures can be sparse or nonexistent. In addition, there\u2019s no guarantee that you\u2019ll be able to have a <a href=\"https:\/\/www.homelight.com\/blog\/how-home-inspection-works\/\">home inspection<\/a> done on a foreclosure auction property. For that reason, you\u2019ll want to prepare financially for probable repairs and updates. <a href=\"https:\/\/www.homelight.com\/agents\/maureen-connolly-ny-30co0948982\">Maureen Connolly<\/a>, a real estate agent in New York with 17 years experience, says that it\u2019s best to bid locally when possible, so that you can at least do a drive-by of the property to visually assess it from the road. Keep in mind that (despite what reality TV may lead you to believe) walking onto the property and peering into windows <a href=\"https:\/\/realestate.findlaw.com\/land-use-laws\/trespassing-basics.html\">is not legal<\/a> unless otherwise specified on the listing.<\/p>\n<p>A <a href=\"https:\/\/www.homelight.com\/blog\/title-searches\/\">title search<\/a> is also a good idea. A home may move into foreclosure due to failure to pay tax assessments in addition to mortgage payments. In that case, there will be a <a href=\"https:\/\/www.thebalance.com\/definition-of-equity-of-redemption-2866606\">tax lien<\/a> placed on the property until the debt is settled. To conduct a <a href=\"https:\/\/www.rocketlawyer.com\/article\/how-to-do-a-property-title-search-for-free-ps.rl\">title search<\/a>, you can either visit the county courthouse in person or search the local county assessor website.<\/p>\n<h3>Figure out your budget<\/h3>\n<p>Before you go into an auction, you\u2019ll need to know how much you can and should bid. Many times the opening bid represents the amount owed on the property (a <b>minimum bid auction<\/b>); other times, it\u2019s set much lower in an effort to attract bidders (an <b>absolute auction<\/b>). Either way, there are three things to keep in mind.<\/p>\n<ul>\n<li><a href=\"https:\/\/www.investopedia.com\/articles\/mortgages-real-estate\/10\/should-you-buy-at-an-auction.asp\">A bank is not allowed to make money on a foreclosure auction<\/a>. Anything gained on the auction after tax liens are satisfied will revert to the previous homeowner.<\/li>\n<li>An auctioneer may set a <a href=\"https:\/\/www.investopedia.com\/terms\/r\/reserve-price.asp\">hidden reserve<\/a> if a bank has a minimum that they will accept for the property. If the reserve is not met, the seller (bank trustee) has no obligation to sell the property \u2014 even to the highest bidder.<\/li>\n<li>Good deals have limits. Research recently sold comparable homes in the area to know what constitutes a wise purchase in the property\u2019s neighborhood and set a threshold for your top bid. A <a href=\"https:\/\/www.homelight.com\/buying\">top-performing real estate agent<\/a> can help.<\/li>\n<\/ul>\n<p>You\u2019ll also want to give yourself a generous budget to account for probable repairs and updates. If someone hasn\u2019t been able to make their mortgage payments, there are probably other home maintenance tasks that have fallen by the wayside.<\/p>\n<p>Connolly says that her buyers have seen major repairs come up after foreclosure auctions, such as the need to replace plumbing and electrical systems. They have a strategy for getting a profitable deal at auction, and so should you!<\/p>\n<ul>\n<li><b>Sign up for email alerts.<\/b> Time is your friend when it comes to foreclosure property research, so make sure you hear about potential auctions as early as possible.<\/li>\n<li><a href=\"https:\/\/www.homelight.com\/blog\/buyer-documents-needed-for-mortgage\/\"><b>Get your financing in order<\/b><\/a><b>.<\/b> If you\u2019re <a href=\"https:\/\/www.homelight.com\/blog\/mortgages-101\/\">getting a mortgage<\/a>, be sure to go through the <a href=\"https:\/\/www.homelight.com\/blog\/difference-between-mortgage-prequalification-preapproval\/\">pre-approval process<\/a>. If you\u2019re paying cash, have your proof of funds ready. (Note: many in-person auctions <a href=\"https:\/\/www.auction.com\/blog\/buying-foreclosures-at-auction-the-basics\/\">require a cash purchase<\/a>. Check the rules.)<\/li>\n<li><b>Register early.<\/b> Yes, you\u2019ll need to pay your deposit at this time, but the deposit is refundable. You\u2019ll want access to any and all updates that registered bidders get.<\/li>\n<li><a href=\"https:\/\/www.daveramsey.com\/blog\/how-to-buy-a-house-at-auction\"><b>Develop a formula<\/b><\/a><b>.<\/b> A suggested rule of thumb is market value, times percentage of marketability, minus cost of repairs. Meaning, if comparable sales of a well-kept house in the neighborhood go for $100,000, but this property is only worth 80% of that price in its present condition, and it will take $20,000 to make repairs, then your maximum bid should be $60,000.<\/li>\n<li><b>Keep emotions in check.<\/b> Don\u2019t let the excitement of the auction pressure you to go above your maximum bid. Start low and be savvy.<\/li>\n<li><b>Purchase <\/b><a href=\"https:\/\/www.nolo.com\/legal-encyclopedia\/title-insurance-buyer-needs-36126.html\"><b>title insurance<\/b><\/a><b>.<\/b> Yes, you\u2019ve done your research, but title insurance protects you just in case there were hidden liens on the property.<\/li>\n<li><b>Wait for the certificate of title.<\/b> If you win an auction, <b><i>do not<\/i><\/b> make any improvements until you have the title in hand. The prior owners may <a href=\"https:\/\/www.auction.com\/blog\/buying-foreclosures-at-auction-the-basics\/\">contest the sale,<\/a> so you don\u2019t want to invest money until the title is in your name.<\/li>\n<li><b>Bid again.<\/b> If you lose your first auction \u2014 or your first couple auctions \u2014 don\u2019t be disheartened. Chalk each experience up to the learning process and jump back in when you\u2019re ready.<\/li>\n<\/ul>\n<p>Buying a foreclosed home at auction can be risky, but it can also present an opportunity to get a good deal. <b>Do your homework, and enlist the help of professionals when necessary.<\/b> A <a href=\"https:\/\/www.homelight.com\/blog\/real-estate-attorney\/\">real estate lawyer<\/a> is an excellent resource, as is an expert <a href=\"https:\/\/www.homelight.com\/buying\">real estate agent<\/a> in your area.<\/p>\n<p>Because of the nuances in auction regulations, local knowledge of real estate auction procedures is imperative when embarking on this kind of adventure, especially for the first time, so don\u2019t hesitate to consult a local expert.
