Sounds like a bunch of jargon! It helps to know that escrow has a couple of distinct but related meanings in real estate.<\/p>\n<h3><b>Closing time<\/b><\/h3>\n<p>Escrow refers to a specific period of time in a real estate transaction between offer and close. Escrow kicks off after you sign the purchase agreement from a buyer, and it ends when all the funds are disbursed at closing.<\/p>\n<p>\u201cOnce we have a fully executed contract in which the buyer and seller both sign off on the particular offer, then the buyer is required to deposit \u2018earnest money\u2019 into the escrow company,\u201d says <a href=\"https:\/\/www.homelight.com\/agents\/ehren-alessi-nv-s0061860\">Ehren Alessi<\/a>, a top Las Vegas real estate agent who\u2019s sold 86% more single family homes than his peers.<\/p>\n<p>So begins escrow. Now, your home sale will circle the runway like a plane for at least several weeks. That\u2019s because most transactions hinge on meeting a number of contingencies laid out in the contract \u2014 like the <a href=\"https:\/\/www.homelight.com\/blog\/how-home-inspection-works\/\">inspection<\/a>, <a href=\"https:\/\/www.homelight.com\/blog\/what-to-expect-from-a-home-appraisal\/\">appraisal<\/a>, and <a href=\"https:\/\/www.homelight.com\/blog\/title-searches\/\">title search<\/a> \u2014 and it takes time to meet these contingencies before closing.<\/p>\n<h3>A third-party account for safekeeping<\/h3>\n<p>During this holding pattern, which can last <a href=\"https:\/\/newventureescrow.com\/how-long-does-escrow-take\/\">30-60 days<\/a>, a third-party escrow account will open up to safely hold any funds and key paperwork related to the transaction at an arm&#8217;s length. This may include, in addition to your buyer\u2019s earnest money, <a href=\"https:\/\/www.amfam.com\/resources\/articles\/at-home\/what-are-escrow-fees\">real estate fees, loan fees, third party payments, and your profits as the seller.<br \/>\n<\/a><\/p>\n<p>To avoid any conflict of interest, an escrow officer or title company will manage the account. If you think of the alternative \u2014 you or the buyer personally hanging onto the money all that time \u2014 it\u2019s clear why no one would be comfortable moving forward without an escrow arrangement.<\/p>\n<p>But escrow isn\u2019t free. Escrow service fees which cover the holding of funds and transfer of documents may vary from state to state, and you and the <a href=\"https:\/\/www.homelight.com\/net-proceeds-calculator\">buyer will likely split the costs<\/a>.<\/p>\n<h2>What\u2019s the seller\u2019s job during escrow?<\/h2>\n<p>While the buyer works to finalize the details of their mortgage and schedule the home inspection, the seller should take care of the following:<\/p>\n<h3>Prepare disclosures for your buyer<\/h3>\n<p>If you haven\u2019t already provided your buyer with necessary property disclosures that document any known issues about your house, you\u2019ll likely need to do so within a few days after you accept an offer as part of moving escrow forward. The seller\u2019s disclosure statement is a <a href=\"https:\/\/www.nolo.com\/legal-encyclopedia\/required-disclosures-selling-real-estate-30027.html\">legally binding document<\/a>, so remember to:<\/p>\n<ul>\n<li><b>Be honest when you fill out the form<\/b>:<br \/>\nIf you lie or try to cover up a hazard or problem with your property, that\u2019s not just bad karma; you <a href=\"https:\/\/www.nolo.com\/legal-encyclopedia\/required-disclosures-selling-real-estate-30027.html\">may be held legally responsible if a buyer claims damages<\/a>.<\/li>\n<li><b>Share anything you\u2019re already aware of, don\u2019t look for problems:<\/b><br \/>\nDisclosures are meant to help buyers make an informed decision about the property they\u2019re purchasing, but sellers can\u2019t be expected to go evaluating their house for problems or share details they aren\u2019t privy to.<\/li>\n<li><b>Return the disclosure form to the buyer in a timely manner<\/b>:<br \/>\nDisclosure form due dates <a href=\"https:\/\/www.homelight.com\/blog\/mandated-disclosures-real-estate\/\">vary by state<\/a>, but the sooner you can provide yours to the buyers, the better. If the buyers decide a particular issue is a deal-breaker, it\u2019s in everyone\u2019s best interest to cancel the contract now versus waste time taking additional steps to closing.<\/li>\n<\/ul>\n<p>Note that real estate disclosure requirements vary among states. Most states have their own disclosure forms with some states\u2019 being \u201ccaveat emptor\u201d or buyer beware \u2014 meaning there\u2019s no official disclosure laws. We have a list of <a href=\"https:\/\/www.homelight.com\/blog\/mandated-disclosures-real-estate\/\">all 50 states\u2019 individual rules with links to their respective forms<\/a>, but real estate agents generally advise sellers to be forthcoming about any known issues or material defects with the property out of good faith.<\/p>\n<h3>Be responsive to any title issues or questions<\/h3>\n<p>As part of a \u201cbackground check\u201d on your house, a buyer\u2019s lender will require a <a href=\"https:\/\/www.homelight.com\/blog\/title-searches\/\">title search <\/a>that essentially evaluates the property\u2019s history of ownership, identifies any <a href=\"https:\/\/www.forbes.com\/advisor\/mortgages\/liens\/\">outstanding liens<\/a> against it, verifies that you\u2019re the sole owner of the home and that you have the right to sell it, and ensures the details of the home (size and location, for example) are recorded properly.<\/p>\n<p>During this time you\u2019ll want to be available to dispute or respond to any issues with the title that may arise. You\u2019ll need to, for example, provide receipts for contractor work that\u2019s showing up as unpaid, write a check for any outstanding child support acting as a lien against the property, or clear up a boundary encroachment concern.<\/p>\n<p>A <a href=\"https:\/\/www.homelight.com\/blog\/preliminary-title-report\/\">preliminary title search<\/a> is one option to get ahead of any title issues so you aren\u2019t blindsided during escrow. Though certainly not mandatory, a preliminary title search conducted before you list the property can give you peace of mind that your title will likely clear later on.<\/p>\n<p>Alessi recalls a preliminary title report that revealed the home\u2019s parcel numbers were recorded incorrectly to make it seem like the property was smaller than it was. \u201d[This] is a big deal, because if I\u2019m selling my home and a plot of that land isn\u2019t included it drops the value of the property or I can\u2019t sell it until it\u2019s recorded the right way,\u201d he says.<\/p>\n<h3>Make your home available for the inspection<\/h3>\n<p>There\u2019s a good chance your buyer will schedule a home inspection \u2014 <a href=\"https:\/\/www.nar.realtor\/sites\/default\/files\/documents\/2020-03-realtors-confidence-index-04-17-2020.pdf\">57% of contracts<\/a> in March 2020 required one. The buyer arranges and pays for this, but here\u2019s how you can help:<\/p>\n<ul>\n<li><b>Complete necessary repairs before you list the home<\/b><b><br \/>\n<\/b>If you can, get ahead of any <a href=\"https:\/\/www.homelight.com\/blog\/how-home-inspection-works\/\">issues likely to crop up in the inspection<\/a> that could delay your settlement. Inspectors are primarily going to focus on signs of water damage, structural issues, aging roof, old electrical, plumbing problems, pest infestation, and issues with the HVAC system.<\/li>\n<li><b>Communicate your availability <\/b><br \/>\nAs the seller you\u2019ll need to leave for the inspection, so let your agent know which days and times would work for an inspector to come through so they communicate that with the buyer\u2019s agent. Keep in mind that home inspectors often <a href=\"https:\/\/icaschool.com\/\">complete 3-4 inspections per day<\/a> so the more flexible you are, the quicker you should be able to complete this step.<\/li>\n<li><b>Keep your home clean and accessible<\/b><br \/>\nYour teetering stack of moving boxes shouldn\u2019t block the crawl space the inspector needs to access to complete the inspection. Make sure you also leave items like keys for locked basement doors or <a href=\"https:\/\/www.homelight.com\/blog\/home-inspection-tips\/\">remote controls for fans<\/a> where they can find them, like on the kitchen counter.<\/li>\n<li><b>Consult in advance with your agent for what fixes you\u2019ll allow<\/b><br \/>\nGo through a <a href=\"https:\/\/www.homelight.com\/blog\/home-inspection-report\/\">sample inspection report<\/a> with your agent so you\u2019re not making an emotional decision when the clock is ticking.<\/li>\n<\/ul>\n<h3>Get past the appraisal<\/h3>\n<p>The lender needs an appraisal to confirm your home is worth the price you\u2019re selling it for. Appraisers typically do an onsite visit as part of their evaluation, so therefore:<\/p>\n<ul>\n<li><b>Check your phone or email for updates<\/b><br \/>\nYou need to agree to the appointment before it\u2019s scheduled \u2014 updates will pop from appraiser to buyer\u2019s agent to your agent to you and back again.<\/li>\n<li><b>Prepare your home like a showing<\/b><br \/>\n<a href=\"https:\/\/www.homelight.com\/blog\/home-appraisal-dos-and-donts\/\">Mow your lawn<\/a> and trim any weeds that snuck their way in, and freshen up any clutter that\u2019s appeared since the height of showing season.<\/li>\n<li><b>Organize paperwork ahead of time<\/b><br \/>\n<a href=\"https:\/\/www.homelight.com\/blog\/what-is-a-home-appraisal\/\">Write up the details of any major renovations,<\/a> so your appraiser knows how much you spent on the palatial master bathroom you\u2019re a little bummed to leave behind.<\/li>\n<\/ul>\n<h3>Pay off your mortgage<\/h3>\n<p>Paying off your mortgage is a satisfying moment, but <a href=\"https:\/\/www.gofirstam.com\/resources\/the-escrow-closing-process.html\">your escrow officer will likely get to do the honors<\/a>. They\u2019ll order a <a href=\"https:\/\/www.consumerfinance.gov\/ask-cfpb\/what-is-a-payoff-amount-is-my-payoff-amount-the-same-as-my-current-balance-en-205\/\">payoff statement<\/a> during the escrow process to confirm <a href=\"https:\/\/homeguides.sfgate.com\/request-payoff-mean-mortgage-loans-100783.html\">what you still owe on your mortgage<\/a> so that when you reach closing day, they know how much to send to your lender to close it out.<\/p>\n<p>They won\u2019t touch your escrow account for homeowners insurance and property taxes, however (if you still have one). There are only a couple of occasions where the escrow account would stay open:<\/p>\n<ol>\n<li style=\"list-style-type: none;\">\n<ol>\n<li><b>You \u2018rent-back\u2019 your home from the new buyer<\/b>:<br \/>\nIf, for whatever reason, you realize you won&#8217;t have another place to live after closing, <a href=\"https:\/\/www.homelight.com\/blog\/buyer-seller-still-in-house-after-closing\/\">you can negotiate with your buyer<\/a> to see if they\u2019ll let you pay rent to delay your move out date. You\u2019d have to add this into the contract, and would most likely keep a security deposit in the escrow account until you officially move out.<\/li>\n<li><b>You are waiting on repairs to be completed:<\/b><br \/>\nIf weather or a busy contractor season delays repairs you agreed to cover during negotiations, you may be able to close on time but keep the funds for the repairs in the escrow account until they\u2019re completed.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<p>Escrow can be an anxious few weeks for everyone in a real estate deal, since so many details need to come together and there\u2019s so much money on the line. When in doubt, work with a <a href=\"https:\/\/www.homelight.com\/find-real-estate-agents\">top local agent<\/a> who\u2019s seen it all and will guide you to the bitter end.
