Or perhaps you\u2019re dealing with a pandemic or quarantine situation and, for everyone\u2019s health, you need to minimize the number of face-to-face visits you have. They don\u2019t even need to sign the paperwork on the same day! Sellers and buyers can have entirely separate closings, whether at a title company or attorney\u2019s office.<\/p>\n<p>You could sit in different rooms, which many <a href=\"https:\/\/www.homelight.com\/blog\/title-company\/\">title companies<\/a> started doing <a href=\"https:\/\/www.homelight.com\/blog\/buyer-coronavirus-real-estate-closing\/\">during the coronavirus pandemic<\/a>. If the seller has moved out of state already, they could have their paperwork notarized and mailed back, or they could sign papers through an online portal.<\/p>\n<p>The seller doesn\u2019t have to sign as much paperwork as the buyer probably does because they\u2019re not taking out a mortgage. Prior to the coronavirus pandemic, 14 states had permanent laws allowing for remote online notarizations (RON), and as of May 12, 2020, <a href=\"https:\/\/www.nationalnotary.org\/notary-bulletin\/blog\/2020\/03\/answers-urgent-questions-notaries-ron\">31 enacted emergency RON measures<\/a>, according to the National Notary Association (NNA).<\/p>\n<p>When you close remotely, you sign documents online through a web portal or another digital service, such as DocuSign. Your e-signature carries the same weight as a \u201cwet\u201d signature, or one written on printed paper.<\/p>\n<p>When Mark Wilcox sold his D.C. condo, he was already living in Texas. He sold it completely remotely, using DocuSign, and \u201ceverything went so seamlessly; It wasn\u2019t a big concern signing electronically.\u201d<\/p>\n<p>When he bought again in <a href=\"https:\/\/www.homelight.com\/portland-or\/top-real-estate-agents\">Portland, Oregon<\/a>, with agent <a href=\"https:\/\/www.homelight.com\/agents\/bonnie-roseman-or-910200104\">Bonnie Roseman<\/a>\u2019s help, they submitted his offer and completed all paperwork electronically.<\/p>\n<p>\u201cI attended his closing by phone,\u201d Roseman says, \u201cto be able to answer questions and make sure that things were okay.\u201d Even though she normally attends all her closings, during the coronavirus pandemic, the title company only allowed signers into the office.<\/p>\n<h3>Remote closing by mobile notary<\/h3>\n<p>A mobile notary can bring the closing documents to your home and handle the closing right there in your living room. Or the documents will be mailed to you, then you will sign them with a notary present and send them back.<\/p>\n<p>Roseman had clients in California use mobile notaries to close on a home in Oregon. She explains that, \u201cMobile notaries are approved by particular title companies. During the coronavirus pandemic, title companies sanitized rooms, provided brand new pens for signers to take with them, and took other social distancing measures. Nobody had to be in the same room together. Where this wasn\u2019t possible, title companies tried to seat buyers and sellers at opposite ends of a long table.<\/p>\n<p>For most closings, it\u2019s unlikely that anyone other than the buyers, sellers, and escrow agent will be there. While in the past, \u201cWe could have a <a href=\"https:\/\/www.homelight.com\/blog\/who-is-present-at-closing\/\">roomful of people<\/a>,\u201d Birchen says, during the pandemic, \u201cIt\u2019s hardly any, and the agents can\u2019t be there, either.\u201d<\/p>\n<p>With \u201cwitness-only\u201d closings, the notary or an attorney comes to you and the seller; You <a href=\"https:\/\/www.homelight.com\/blog\/what-to-bring-at-closing\/\">sign all documents<\/a>, and they take care of any disbursements. Buyer and seller can sit down together, or they can meet separately.<\/p>\n<p>However, at witness-only closings, the person conducting the closing will not explain the legal ramifications of what you\u2019re signing, and they\u2019re not legal in all states. If you\u2019re a <a href=\"https:\/\/www.homelight.com\/blog\/buyer-how-to-buy-your-first-home\/\">first-time homebuyer<\/a> and want someone to walk you through the documents, this might not be your best option.<\/p>\n<h2>Creative solutions<\/h2>\n<p>In states that don\u2019t allow RON but where you need to take precautions for health or other reasons, sometimes you might have to get creative.<\/p>\n<p>Roseman couldn\u2019t attend one client\u2019s closing during the coronavirus pandemic, so she sat with her on the phone to answer any questions that might come up. Afterward, though, she needed to deliver a book about their house that she assembles for her clients. \u201cI wore gloves, put the book in a bag, and walked halfway to meet her,\u201d she explains.<\/p>\n<p><a href=\"https:\/\/www.homelight.com\/rapid-city-sd\/top-real-estate-agents\">Rapid City<\/a> agent <a href=\"https:\/\/www.homelight.com\/agents\/shauna-sheets-sd-15646\">Shauna Sheets<\/a>, who sells homes 68% faster than the average Rapid City agent, represented both the buyer and the seller in one transaction. The sellers had already moved out of their home and into assisted living when the time came to close.<\/p>\n<p>\u201cThey were on total lockdown,\u201d Sheets recalls. \u201cSo we coordinated a time, someone came out and gathered the documents, and took them inside. They had a notary there and an assistant on speakerphone walking them through what they were signing. When they\u2019d finished, they brought it all back out.\u201d<\/p>\n<p>Another agent <a href=\"https:\/\/www.homelight.com\/blog\/agent-real-estate-covid-19-agents-adapting\/\">passed paperwork through a window<\/a> to protect an immunocompromised child in the house.
