A short sale is a way for a homeowner who owes more on their property than it is worth to sell their house and avoid foreclosure while appeasing all of their lenders \u2014 think \u201ccoming up short\u201d rather than \u201ca short walk around the block.\u201d<\/p>\n<p>As a buyer, this means you\u2019ll have to work with the seller and the seller&#8217;s <a href=\"https:\/\/www.homelight.com\/blog\/buyer-how-do-home-loans-work\/\">lenders<\/a> to negotiate the sale, which <i>will<\/i> take time (imagine trying to get children at a party to agree on how to fairly split a small cake which, no matter how it\u2019s split, will leave them all unsatisfied). Additionally, the property itself will come &#8216;as is,&#8217; meaning you will most likely need to spend time and money on renovations and repairs after the purchase before moving in. For sellers, this highlights the appeal of <a href=\"https:\/\/www.homelight.com\/blog\/selling-a-house-as-is\/\">selling a home as is<\/a> to buyers who are willing to take on the necessary updates.<\/p>\n<p>Patience and persistence in a short sale have their rewards and can save you money in the long run \u2014 the process is simply more of a marathon than a sprint. Hire an agent who knows what they are doing<\/h2>\n<p>When you know you are going to start looking seriously at short sales, it is paramount, as ever, to <a href=\"https:\/\/www.homelight.com\/blog\/short-sales-realtor\/\">find the right agent<\/a>.<\/p>\n<p><a href=\"https:\/\/www.homelight.com\/agents\/glen-henderson-ca-01384181\">Glen Henderson<\/a>, one of the top agents in <a href=\"https:\/\/www.homelight.com\/san-diego-ca\/top-real-estate-agents\">San Diego<\/a>, California, ran one of the top three short-sale negotiation groups in San Diego during the last financial crisis. Henderson explains that while there is special training for agents interested in working with short sales (the National Association of Realtors offers a <a href=\"https:\/\/www.nar.realtor\/education\/designations-and-certifications\/sfr\">short sale certification<\/a>), the most important qualification an agent can have is a proven track record in the often complex and time-sucking process of short sales.<\/p>\n<p><a href=\"https:\/\/www.homelight.com\/blog\/short-sales-realtor\/\">Finding the right short-sale agent<\/a> will save you <i>lots <\/i>of headaches down the road and help you avoid things like <a href=\"https:\/\/www.bankrate.com\/finance\/real-estate\/unpaid-liens-can-ruin-a-short-sale.aspx\">undisclosed liens<\/a> (yikes!) and inflexible <a href=\"https:\/\/www.homelight.com\/blog\/buyer-real-estate-contract\/\">purchase agreements<\/a>.<\/p>\n<h2>2. Get preapproved<\/h2>\n<p>Getting preapproved (<a href=\"https:\/\/www.homelight.com\/blog\/difference-between-mortgage-prequalification-preapproval\/\">different than pre-qualification!<\/a>) for a mortgage can be one of those checklist items that falls to the wayside, but don\u2019t allow yourself to forget about it \u2014 especially when you\u2019re pursuing a short sale.<\/p>\n<p>Make sure to communicate with your lender about the fact that you are looking into a short sale. Because short sales often occur on a lengthy timeline, you\u2019ll want to find a lender who is flexible with how long your mortgage application is valid.<\/p>\n<p>It is <i>possible<\/i> that you will be able secure a <a href=\"https:\/\/www.homelight.com\/blog\/mortgage-myths-you-should-dismiss\/\">mortgage<\/a> through the current homeowner\u2019s lender or bank (and you\u2019ll be working with them, anyway, to negotiate the sale) \u2014 but you\u2019ll be wise to do some comparison shopping for a mortgage! Find a short sale house for sale<\/h2>\n<p>OK, you know you want one \u2014 now, how do you find them?<\/p>\n<p>To start with, some homes are simply listed as \u201cshort sale,\u201d in which case your job as a housing sleuth is easy! In other cases, listings might have language that tips you off to the fact that this is a short sale. Keep an eye out for phrases like \u201csubject to bank approval\u201d or \u201cgive the bank time to respond.\u201d<\/p>\n<p>You can also look for homes that are in default or pre-foreclosure; these can be <a href=\"https:\/\/fitsmallbusiness.com\/pre-foreclosure-leads\/\">listed online<\/a> or in legal ads. Your real estate agent will be able to search the <a href=\"https:\/\/www.homelight.com\/blog\/buyer-what-is-the-mls-multiple-listing-service\/\">multiple listing service or MLS<\/a> (only available to real estate agents) to help you find homes that are in pre-foreclosure. Agents can also help you identify homes where the current owner doesn\u2019t have much <a href=\"https:\/\/www.homelight.com\/blog\/what-is-home-equity\/\">equity<\/a> in the house \u2014 the less equity the owner has, the more likely their lenders are to be interested in a short sale.<\/p>\n<h2>4. Contextualize the neighborhood<\/h2>\n<p>Context, context, context! Although it\u2019s great to get a house for a lower price (especially if price is one of your main deciding factors), it\u2019s equally important to know the context of your home in the greater neighborhood. This will help you to make educated decisions about its likely appreciation or depreciation over time.<\/p>\n<p>What are the <a href=\"https:\/\/www.homelight.com\/blog\/houses-sold-near-me\/\">home price<\/a> trends in the neighborhood? Has the neighborhood weathered previous economic storms? If yes, then it\u2019s more likely to do so again, making the home a safer investment. Take a tour with an eye on the bones<\/h2>\n<p>Touring a short-sale property is simply not going to be as aesthetically pleasing or soothing as a house tour on the regular market. It is unlikely that the seller will stage the house, so there will likely be cosmetic issues&#8230; and, <i>ahem<\/i>, \u201cpersonal\u201d decor choices \u2014 not to mention clutter.<\/p>\n<p>While touring, try to <a href=\"https:\/\/www.homelight.com\/blog\/buyer-home-inspection-tips-for-buyers\/\">focus on issues<\/a> that would require major structural repair, like pests, obvious moisture or dampness, and faulty electrical connections. Remember, you\u2019re trying to get a feel for how much of a construction project the house will be \u2014 walk in the door knowing that you are not touring a perfectly lit and landscaped dream home.<\/p>\n<h2>6. How much is the house worth?<\/h2>\n<p>Before putting an offer on the house, you\u2019ll need to determine how much it is worth \u2014 and how much the current homeowner still owes on it.<\/p>\n<p>The best way to determine the market value of the house is to pay for a professional <a href=\"https:\/\/www.homelight.com\/blog\/buyer-home-appraisal-tips\/\">appraisal<\/a>. Contact the lender<\/h2>\n<p>Again, because this is a short sale, you not only have to work with the seller, but with the seller\u2019s lenders, as well! Your agent should guide you in getting an <a href=\"https:\/\/www.richardadamslaw.com\/wp-content\/uploads\/2012\/02\/RealTimeSolutions.pdf\">authorization letter<\/a> from the homeowner that will legally allow for the lender to talk with you and your agent about the property. You will need to get this letter <a href=\"https:\/\/www.thebalance.com\/what-is-a-notarized-document-315434\">notarized<\/a> before approaching the lender.<\/p>\n<p>It is also advised that you and your agent get the name and phone number of someone in the lender&#8217;s loss mitigation or resource recovery department \u2014 both to get a feeling for what the lender\u2019s requirements are for a successful short sale, and so you have a personal contact to follow up with throughout the approval process.<\/p>\n<h2>8. Get an <a href=\"https:\/\/www.homelight.com\/blog\/buyer-types-of-home-inspections\/\">inspection<\/a><\/h2>\n<p>In a short sale, you\u2019re getting exactly what you see, which means in most cases, you won\u2019t be able to ask the seller for additional fixes or updates to the property before you buy.<\/p>\n<p>Getting a thorough and clear home inspection is <i>really <\/i>important \u2014 it will tell you what major and minor repairs are in store so that you can accurately calculate whether owning <i>and <\/i>updating the house to a safe living standard are within your budget. Do the title research (and get title insurance)<\/h2>\n<p>Once the purchase of the property is completed, you will be responsible for any liens on the house. This is fine if you know about all the liens and can figure them into your financial plan for the property. This is less fine if there are any undisclosed liens on the house that come to light after the sale.<\/p>\n<p>A <a href=\"https:\/\/www.homelight.com\/blog\/title-searches\/\">title search<\/a> will ensure that you know about <i>all <\/i>liens, plan for them, and don\u2019t get surprised after closing. Remember: Even if you don\u2019t know a lien exists, you will be legally responsible for it once you own the property. Even if they\u2019re not trying to trick you, sellers might not fully understand what liens are active on the house, or that they are withholding information that they should disclose.<\/p>\n<p>Getting <a href=\"https:\/\/www.oldrepublictitle.com\/homeowners\/education\/what-is-title-insurance#:~:text=To%20put%20it%20simply%2C%20title,prevention%2C%20rather%20than%20risk%20assumption.\">title insurance<\/a> is a great way to protect yourself against undisclosed liens and other <a href=\"https:\/\/www.nolo.com\/legal-encyclopedia\/title-insurance-buyer-needs-36126.html#:~:text=Your%20escrow%20or%20closing%20agent,around%20%241%2C000%20for%20title%20insurance.\">nasty surprises<\/a>. Title insurance will cover any legal costs to protect your home and your investment against undisclosed liens.<\/p>\n<h2>10. Get your application together<\/h2>\n<p>It\u2019s finally time to get your application together! While the right agent should take the lead on this process, it\u2019s good to be prepared by knowing what will be in the application.<\/p>\n<p>Some things on this list are pretty straightforward: you\u2019ll need to provide an appraisal, a list of any liens on the property, and a copy of an <a href=\"https:\/\/www.homelight.com\/blog\/how-to-protect-earnest-money\/\">earnest money cashier\u2019s check<\/a>. You will need to provide a package from the seller, too, which includes a <a href=\"https:\/\/www.nolo.com\/legal-encyclopedia\/short-sale-hardship-letters.html\">hardship letter<\/a> and financial information. If the house was listed on the market, you will also need to include a listing agreement.<\/p>\n<p>Finally, you will need to provide a purchase offer written by your agent. Don\u2019t sign anything you don\u2019t understand!<\/h2>\n<p>Like cautionary tales of fine-print-skimming everywhere, signing a short sale agreement without reading and understanding it fully won\u2019t end well for you \u2014 make sure you <a href=\"https:\/\/www.homelight.com\/blog\/offer-to-purchase-real-estate\/\">understand<\/a> what you\u2019re signing on to.<\/p>\n<p>A good agent will be able to walk you through the process and the contract, but don\u2019t be afraid to ask what might seem like stupid questions along the way. Better \u201cstupid\u201d questions now then surpise pitfalls later!<\/p>\n<h2>12. Accept, reject, or counter-offer \u2014 or, worse, silence!<\/h2>\n<p>Now that you\u2019ve submitted your offer it\u2019s time to hurry up and\u2026 wait.<\/p>\n<p>Waiting can end in hearing back from the bank that they will be accepting, rejecting, or making a counter-offer. However, waiting could also end in more waiting and, ultimately \u2014 silence.<\/p>\n<p>Banks reject short sale applications for <a href=\"https:\/\/www.thebalance.com\/top-reasons-banks-reject-short-sale-offers-1799089\">a number of reasons<\/a>. Even if you and your agent are checking in regularly with the bank, it can be hard to tell when to keep waiting. KEEP LOOKING<\/h2>\n<p>A watched pot never boils, and a short sale house application may be met with unresolved silence \u2014 hopefully this isn\u2019t the case and you are able to get the keys, pop the champagne, and get to work on those home repairs!<\/p>\n<p>But either way, some of the best advice we can give you is simply this: Keep looking!
