If you fail to pay off the lien, as well as the additional penalties and interest, that private investor can then foreclose on your home as a repayment of the debt.<\/p>\n<p>The upside is that a private investor may be flexible and willing to compromise on the payment timeline or the amount owed. Government entities are less likely to be flexible, and both your <a href=\"https:\/\/www.nolo.com\/legal-encyclopedia\/what-happens-if-you-dont-pay-property-taxes-your-home.html\">state\u2019s department of revenue<\/a> and <a href=\"https:\/\/www.irs.gov\/newsroom\/what-if-there-is-a-federal-tax-lien-on-my-home\">the IRS<\/a> are willing and able to foreclose on your home, too, if their tax liens aren\u2019t paid in full.<\/p>\n<div id=\"section--2\" data-toc-header=\"Why is my tax lien higher than the taxes owed?\" data-toc-type=\"head\"><\/div>\n<h2>Why is my tax lien higher than the taxes owed?<\/h2>\n<p>Just like any other debt owed, when you have unpaid taxes, the government is going to charge you <a href=\"https:\/\/www.irs.gov\/taxtopics\/tc653\">interest and penalties<\/a> when you don\u2019t pay up on time. And sometimes, that failure-to-pay penalty can be as high as 100% of your tax debt \u2014 <a href=\"https:\/\/www.irs.gov\/businesses\/small-businesses-self-employed\/employment-taxes-and-the-trust-fund-recovery-penalty-tfrp\">which can be the case with unpaid employment taxes<\/a>.<\/p>\n<p>Wenatchee, Washington-based real estate agent <a href=\"https:\/\/www.homelight.com\/agents\/perrin-cornell-wa-74737\">J. Perrin Cornell<\/a> provides the following example:<\/p>\n<p>\u201cLet\u2019s say you have a $5,000 lien on your property for unpaid employment taxes. If you incur that 100% penalty, then you\u2019re up to $10,000 plus 12% interest per month. And if you let that lien sit on your property unaddressed for several years, then suddenly your $5,000 nonpayment of taxes is a debt of $20,000 or more.\u201d<\/p>\n<p>As that tax debt piles up, it\u2019ll swiftly eclipse any equity that you\u2019ve built up in your home.<\/p>\n<p>You won\u2019t have that same 100% penalty on all liens, but expect some kind of \u201clate fees\u201d to apply to various unpaid taxes. For income taxes, the federal government <a href=\"https:\/\/www.irs.gov\/taxtopics\/tc653\">charges<\/a> the following penalty:<\/p>\n<p>\u201cOne-half of one percent for each month, or part of a month, up to a maximum of 25%, of the amount of tax that remains unpaid from the due date of the return until the tax is paid in full. The one-half of one percent rate increases to one percent if the tax remains unpaid 10 days after the IRS issues a notice of intent to levy property.\u201d<\/p>\n<p>Failure to file can also incur penalties of between 5% and 25% of the unpaid tax per month.
