One common (but not always standard) inclusion in a rent-to-own contract is asking the buyer to handle any repairs needed while they occupy the house.<\/p>\n<p>This stipulation has an upside for the buyer, too: if they are \u201cgoing to treat their home as if they already own it, then any roof leak, nonfunctioning AC, any of that is going to be a problem in the future when they go to <i>technically<\/i> own it and get a mortgage and get rid of the seller from the transaction,\u201d the agent notes. Taking care of any maintenance issues proactively will benefit the buyers long-term when they become homeowners.<\/p>\n<p>Indeed, Aparo-Griffin says, \u201cusually it&#8217;s the buyer\u201d handling these responsibilities and costs in a rent-to-own situation.<\/p>\n<p>\u201cIf you\u2019re doing a rent-to-own, you are technically a vested, soon-to-be owner. So you have to treat that place as your own. It\u2019s always up to the real estate brokerage firm that\u2019s writing up [the rent-to-own agreement] to clarify that, but for the most part, it&#8217;s usually on the buyer.\u201d<\/p>\n<p>However, that\u2019s not <i>always<\/i> the case. \u201cI have written up some rent-to-owns where the seller is responsible up until a certain time period when the buyer actually gets a standard loan,\u201d Aparo-Griffin says. So you have options!<\/p>\n<div id=\"section--2\" data-toc-header=\"Maintenance issues to expect\" data-toc-type=\"head\"><\/div>\n<h2>Standard maintenance issues for buyers to expect<\/h2>\n<p>Every home comes with <a href=\"https:\/\/www.homelight.com\/blog\/home-maintenance-checklist\/\">standard maintenance matters<\/a> that owners \u2014 or owners-to-be \u2014\u00a0should keep top of mind.<\/p>\n<p>Here\u2019s a general list of things to think about.<\/p>\n<h3>Cleaning out the gutters<\/h3>\n<p>Who\u2019s responsible for doing this, and when will it be done? Homeowners should remove any debris from their gutters and clean them out annually.<\/p>\n<p>Clogged gutters can lead to roof damage \u2014 an expensive repair \u2014 so this ounce of prevention can save buyers significant money long-term.<\/p>\n<h3>Replacing air filters<\/h3>\n<p>Who performs the task, and who pays for the filters? <a href=\"https:\/\/www.homedepot.com\/b\/Heating-Venting-Cooling-Air-Filters\/N-5yc1vZc4kw\">Air filters range in price<\/a> depending on the size and thickness of the filter. Thinner filters are supposed to be replaced monthly, while thicker filters can last up to a year (and are more expensive).<\/p>\n<p>Dirty air filters waste energy because your systems have to work harder; they can even cause your HVAC system to overheat or malfunction. And, of course, replacing air filters will maintain good air quality in your home.<\/p>\n<h3>Maintaining landscaping<\/h3>\n<p>This may include mowing and watering the lawn, and generally keeping up the landscaping around the property.<\/p>\n<p>Is this the responsibility of the buyer or the landlord, and at whose expense? Is there a professional service that handles this, and who arranges and pays for it, if so?<\/p>\n<p>Landscaping isn\u2019t simply a matter of curb appeal. Paying attention to how water drains around the home when you\u2019re watering the lawn, for example, can alert you to structural issues with the house before they become acute.<\/p>\n<h3>Cleaning the fridge coils<b>\u00a0<\/b><\/h3>\n<p>First, you\u2019ll want to establish whose fridge it even is: will it eventually come with the house and pass to the rent-to-owner if it belongs to the seller?<\/p>\n<p>Cleaning the fridge\u2019s coils helps the fridge operate at maximum efficiency, so maintaining this part of the house will save the renter and future buyer money on their energy expenses. Plus, if the fridge is coming with the house, buyers will want to make sure it\u2019s operating at peak condition, anyway.<\/p>\n<h3>Clean the dryer vent<\/h3>\n<p>Again, who owns the appliance in the long run, and who is responsible for it during the rental period? This is another example of a fix that can save buyers money on their energy bills, but backed-up lint and debris in dryer vents can also start fires. For <a href=\"https:\/\/www.amazon.com\/Cleaner-Vacuum-Attachment-Remover-Washer\/dp\/B07TD8DM6L\">$12 on Amazon<\/a>, you can order a vacuum attachment to help you handle this maintenance job.<\/p>\n<h3>Other standard maintenance tasks<\/h3>\n<p>Other tasks for which to establish responsibility include such home maintenance issues as:<\/p>\n<ul>\n<li>Servicing the furnace (annually)<\/li>\n<li>Flushing the water heater (annually)<\/li>\n<li>Touching up exterior paint (as needed)<\/li>\n<li>Caulking windows (as needed)<\/li>\n<li>Minor plumbing repairs (as needed)<\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">\n\n\n\n\n<div class=\"geo-cta widget-cta widget-cta--content     widget-cta--dark widget-cta--dark-blue-gradient\">\n    <div class=\"widget-element--content\">\n        <div class=\"widget-element--content-header\">\n            <img decoding=\"async\" alt=\"homelight logo\" class=\"widget-element--logo\" src=\"https:\/\/www.homelight.com\/blog\/wp-content\/themes\/ccprototypev5\/images\/logo-small-cta.png\" width=\"106\" height=\"25\" \/>\n        <\/div>\n        \n                <h3 class=\"cta-headline widget--bold\">Discover How Much Home You Can Afford With Our Home Affordability Calculator<\/h3>\n                        <p>Understand the costs associated with buying a home and find out what safe budgeting looks like.<\/p>\n        \n                <div class=\"widget-element--buttons\">\n            <a data-type=\"In Content CTA\" href=\"https:\/\/www.homelight.com\/how-much-house-can-i-afford\" class=\"cta-click-track widget-element--button\">Get Started<\/a>\n        <\/div>\n                    <\/div>\n<\/div>\n\n<\/span><\/p>\n<div id=\"section--3\" data-toc-header=\"Major maintenance game changers\" data-toc-type=\"head\"><\/div>\n<h2>Major maintenance issues that could change the game<\/h2>\n<p>Aparo-Griffin says she\u2019d likely <a href=\"https:\/\/www.homelight.com\/blog\/buyer-rent-to-own-home-contract\/\">write in the contract<\/a> that all of the maintenance issues under a certain dollar amount would fall to the buyer.<\/p>\n<p>But that said, there\u2019s a limit to what a buyer should be expected to handle in terms of home maintenance, she adds.<\/p>\n<blockquote><p>\u201cObviously if the roof is bad, you can\u2019t expect somebody who\u2019s renting to own to pay for a $10,000 roof.\u201d<\/p><\/blockquote>\n<p>(She adds that if the parties <i>do<\/i> agree that buyers will be shouldering major home-maintenance responsibilities, the buyer must waive or remove any existing <a href=\"https:\/\/www.homelight.com\/blog\/how-home-inspection-works\/\">inspection contingencies<\/a> prior to taking possession of the property.)<\/p>\n<p>Let\u2019s further consider that <a href=\"https:\/\/www.homelight.com\/blog\/how-much-does-it-cost-to-replace-a-roof\/\">roof example<\/a>.<\/p>\n<p>\u201cSome of the major issues that we run into a lot in Florida are that we have problems with roofs all the time because of hurricanes, hail, tornadoes, you name it,\u201d Aparo-Griffin says. \u201cYou could need a whole new roof. You could have a leaking roof. I was in a house two weeks ago where water was pouring down the wall in the garage.\u201d<\/p>\n<p>So fundamentally, \u201cthe roof issue is a big one,\u201d she explains \u2014 the <i>biggest<\/i> rent-to-own home maintenance concern, in her assessment. \u201cYou have to make sure you have a good roof because at the end of this, when the buyer goes to get financing, the buyer\u2019s not going to be able to do that if the roof is an issue.\u201d<\/p>\n<p>Lenders want to confirm that the house is safe to occupy, and buyers who are hoping to get a <a href=\"https:\/\/www.homelight.com\/blog\/buyer-what-is-a-va-loan\/\">VA<\/a> or <a href=\"https:\/\/www.homelight.com\/blog\/buyer-what-is-the-difference-between-fha-and-conventional-loan\/\">FHA<\/a> loan for the house will need to ensure the house meets FHA or VA standards for safety and condition, too.<\/p>\n<p>In short, examining potential costly future issues (especially the roof) \u201cis probably the most important thing that needs to be done before you execute a rent-to-own contract.\u201d<\/p>\n<p>What are some of the other major issues that might make a would-be buyer want to walk away? Think extensive electrical issues, expensive plumbing repairs, widespread window or door replacements, or an HVAC system that needs extensive repair or even replacement.<\/p>\n<div id=\"section--4\" data-toc-header=\"More rent-to-own home maintenance\" data-toc-type=\"head\"><\/div>\n<h2>What else to know about rent-to-own home maintenance<\/h2>\n<p>The home should be on a <a href=\"https:\/\/www.homelight.com\/blog\/home-repair-insurance\/\">service plan<\/a> during the rent-to-own term, which is in both the seller\u2019s and the buyer\u2019s best interests.<\/p>\n<p>\u201cYou should have a once-a-year maintenance check and specify who\u2019s going to pay for that, so as a seller you know your investment is protected,\u201d Aparo-Griffin explains. \u201cYou know the buyer\u2019s not going to get in there and run it into the ground.\u201d<\/p>\n<p>Remember that while the rent-to-owner is renting, the seller still owns the property. So the seller must carry <a href=\"https:\/\/www.homelight.com\/blog\/homeowners-insurance-rate-increases\/\">homeowners&#8217; insurance<\/a>, and both parties will want to specify who&#8217;s going to pay the insurance deductible.<\/p>\n<p>\u201cIf it&#8217;s a rent-to-own, the most the buyer could get is a rental [insurance] policy,\u201d Aparo-Griffin notes. \u201cBut the homeowner still has to have homeowners&#8217; insurance. If there is a fire, if there is a claim, if there is a hurricane, the buyer can&#8217;t make a claim.
