As excited as you are about the prospect of a successful sale, you\u2019re hesitant to sign a contract without knowing you\u2019ll have somewhere to go. What are your options, other than letting a serious buyer slip away?<\/p>\n<p>Enter the use and occupancy agreement. Often referred to as the \u201cU&amp;O,\u201d this is a fairly common agreement between a buyer and seller, where one of them is permitted to occupy the property for a specified period of time. In some cases, the buyer is the one who requests the U&amp;O, so they can move into the home while still waiting for a mortgage to be finalized and before ownership is legally transferred.<\/p>\n<p>On the flip side, the U&amp;O can allow the seller to remain in the home for a certain amount of time after closing (also known as a \u201crent-back\u201d agreement). Connect with a top agent near you to get an expert opinion on how much your house will sell for, what to fix before listing, and the latest local housing market trends.<\/p>\n        \n                <div class=\"widget-element--buttons\">\n            <a data-type=\"In Content CTA\" href=\"https:\/\/www.homelight.com\/find-agent\/quiz\/seller?#\/qaas=0\/\" class=\"cta-click-track widget-element--button\">Learn More<\/a>\n        <\/div>\n                    <\/div>\n<\/div>\n\n\n<p>Marc Lagrois, a top Michigan real estate agent, says occupancy after closing is a very common occurrence. \u201cIt doesn\u2019t diminish the allure of property, as long as it\u2019s a reasonable timeframe,\u201d he says.<\/p>\n<div id=\"section--1\" data-toc-header=\"How does a U&amp;O differ from a lease?\" data-toc-type=\"head\"><\/div>\n<h2>How does a U&amp;O differ from a lease?<\/h2>\n<p>While a use and occupancy agreement might seem a lot like a lease, there are some fundamental differences.<\/p>\n<p>With a lease, the tenant has <a href=\"https:\/\/www.findlaw.com\/realestate\/landlord-tenant-law\/tenants-and-fair-housing.html\">certain basic rights<\/a>, such as the right to not have their privacy infringed upon, and to not be charged a deposit above a certain amount, among others. With a U&amp;O, the seller inhabiting the home is not contractually granted those <a href=\"https:\/\/www.homelight.com\/blog\/tenant-rights-when-house-is-for-sale\/\">standard rights<\/a>.<\/p>\n<p>Lagrois compares the U&amp;O to an Airbnb rental, in that there is no formal tenant\/landlord relationship. \u201cIt\u2019s just a very limited contract that grants the seller the ability to remain for a fixed period at a fixed rate,\u201d he explains.<\/p>\n<p>According to real estate attorney <a href=\"https:\/\/www.linkedin.com\/in\/legaladvice1\/\">David Reischer<\/a>, a U&amp;O also makes it easier to evict and remove a person from a property if something goes wrong compared to a lease. \u201cA U&amp;O should always specify that the agreement creates a mere license to occupy the premises, and is not a tenancy,\u201d he says.<\/p>\n<p>Another key difference between a U&amp;O and a lease is in their duration. \u201cA U&amp;O is only for a short period of time and is only out of necessity,\u201d explains <a href=\"https:\/\/www.homelight.com\/agents\/shea-adair-nc-275466\">Shea Adair<\/a>, a real estate agent and investor in Raleigh, North Carolina. \u201cA lease is purposeful, where someone wants to use and occupy a structure for a longer period of time and therefore needs to be in agreement with
