A Primer"},"content":{"rendered":"<p>There are few things as stressful as finding a new place to live. Housing and shelter is a basic human need, after all. But when you decide to hunt for a new apartment, buy your first home, or sell and move, how do you know if you\u2019ll be treated fairly?<\/p>\n<p>If you overpay for a house compared to your neighbors, you could end up <a href=\"https:\/\/www.homelight.com\/blog\/how-to-sell-a-house-underwater\/\">underwater on your mortgage<\/a>. Paying more to rent an apartment than your neighbor could cost you hundreds of dollars more. Recognizing housing\u2019s importance in most people\u2019s lives, the government has passed laws to ensure fairness in the housing market.<\/p>\n<p>According to <a href=\"https:\/\/www.massfairhousing.org\/about\/staff\">Meris Bergquist<\/a>, Executive Director of the non-profit Massachusetts Fair Housing Center, \u201cBefore the FHA became law, landlords and home sellers could openly \u2014 and without consequence \u2014 refuse to rent or sell their dwellings to qualified applicants because of their race, color, national origin, religion, sex, familial status, and disability.\u201d<\/p>\n<p>Knowledge is power. This is what\u2019s known as the Fair Housing Act.<\/p>\n<p>Legislators included these titles in part due to redlining. Redlining, or refusing to extend mortgage loans to people who lived in certain neighborhoods based on its racial composition, created segregated neighborhoods.<\/p>\n<p>Otherwise creditworthy families couldn\u2019t access mortgages or other credit products. If they <i>could<\/i> get a loan, they received worse terms and paid higher interest rates than similarly qualified borrowers of a different race. Paying more for their loan resulted in higher foreclosure rates and lost generational wealth.<\/p>\n<p>\u201cThe FHA as a whole was intended to have broad authority to outlaw housing discrimination throughout the nation and encourage racial integration,\u201d says Bergquist.<\/p>\n<p>Several other acts were also included in this legislation apart from Titles VIII and IX, which can get confusing. Sometimes, you\u2019ll hear the terms Fair Housing Act and Civil Rights Act used interchangeably.<\/p>\n<p>Congress passed the act a week after Martin Luther King Jr\u2019s assassination. It outlines most of the protections we enjoy around housing.<\/p>\n<h2>Who\u2019s protected by the Fair Housing Act?<\/h2>\n<p>The act <a href=\"https:\/\/www.justice.gov\/crt\/fair-housing-act-1\">prohibits discrimination<\/a> on the basis of:<\/p>\n<ul>\n<li>Race<\/li>\n<li>Color<\/li>\n<li>National origin<\/li>\n<li>Religion<\/li>\n<li>Sex<\/li>\n<li>Familial status<\/li>\n<li>Disability<\/li>\n<\/ul>\n<p>This means that landlords, sellers, real estate agents, mortgage brokers or loan officers, and other roles involved in real estate transactions cannot discriminate against you based on any of these characteristics.<\/p>\n<p>Not every listed characteristic had protection immediately; sex wasn\u2019t added until 1974, and some communities still lack inclusion.<\/p>\n<p>The LGBT community is <a href=\"https:\/\/www.hrc.org\/resources\/fair-and-equal-housing-act\">still fighting to expand the Act<\/a> to include sexual orientation. Twenty-one states have passed their own <a href=\"https:\/\/www.freedomforallamericans.org\/states\/#:~:text=In%2021%20states%20and%20the%20District%20of%20Columbia%2C,in%20employment%2C%20housing%20and%20public%20accommodations%3A%20California.%20Colorado.\">anti-discrimination laws for sexual orientation<\/a>. These states are:<\/p>\n<ul>\n<li>California<\/li>\n<li>Colorado<\/li>\n<li>Connecticut<\/li>\n<li>Delaware<\/li>\n<li>District of Columbia<\/li>\n<li>Hawaii<\/li>\n<li>Illinois<\/li>\n<li>Iowa<\/li>\n<li>Maine<\/li>\n<li>Maryland<\/li>\n<li>Massachusetts<\/li>\n<li>Minnesota<\/li>\n<li>Nevada<\/li>\n<li>New Hampshire<\/li>\n<li>New Jersey<\/li>\n<li>New Mexico<\/li>\n<li>New York<\/li>\n<li>Oregon<\/li>\n<li>Rhode Island<\/li>\n<li>Vermont<\/li>\n<li>Virginia<\/li>\n<li>Washington<\/li>\n<\/ul>\n<p>Buyers, sellers, and renters in states without these additional laws are not protected from housing discrimination on the basis of sexual orientation.<\/p>\n<figure id=\"attachment_20321\" aria-describedby=\"caption-attachment-20321\" style=\"width: 700px\" class=\"wp-caption alignnone\"><a href=\"https:\/\/www.homelight.com\/blog\/wp-content\/uploads\/2020\/12\/fair-housing-act-building.png\" target=\"_blank\"><img decoding=\"async\" width=\"666\" height=\"381\" src=\"https:\/\/www.homelight.com\/blog\/wp-content\/uploads\/2020\/12\/fair-housing-act-building-666x381.png\" class=\"attachment-content size-content\" alt=\"A building of apartments that adhere to the Fair Housing Act.\" srcset=\"https:\/\/www.homelight.com\/blog\/wp-content\/uploads\/2020\/12\/fair-housing-act-building-666x381.png 666w, https:\/\/www.homelight.com\/blog\/wp-content\/uploads\/2020\/12\/fair-housing-act-building-64x37.png 64w, https:\/\/www.homelight.com\/blog\/wp-content\/uploads\/2020\/12\/fair-housing-act-building-128x73.png 128w, https:\/\/www.homelight.com\/blog\/wp-content\/uploads\/2020\/12\/fair-housing-act-building-192x110.png 192w, https:\/\/www.homelight.com\/blog\/wp-content\/uploads\/2020\/12\/fair-housing-act-building-432x247.png 432w, https:\/\/www.homelight.com\/blog\/wp-content\/uploads\/2020\/12\/fair-housing-act-building-500x286.png 500w, https:\/\/www.homelight.com\/blog\/wp-content\/uploads\/2020\/12\/fair-housing-act-building.png 700w\" sizes=\"(max-width: 666px) 100vw, 666px\" \/><\/a><figcaption id=\"caption-attachment-20321\" class=\"wp-caption-text\"><\/a> Source: (Charlie Harutaka \/ Unsplash)<\/figcaption><\/figure>\n<h2>What does the act outlaw?<\/h2>\n<p>The act\u2019s provisions attempt to address every aspect of housing where discrimination could exist \u2014 from renting to buying or selling a home. Its goal is to ensure equal opportunities for everyone in the housing market.<\/p>\n<h3>Mortgage-related discrimination<\/h3>\n<p>Regardless of your race, color, national origin, religion, sex, disability, or familial status, lenders must treat you the same. For example, lenders cannot refuse to make a loan or provide financial assistance for housing to a person of color that they would offer to a white person.<\/p>\n<p>Lenders also have to provide information around available loans to all borrowers to ensure fairness. Even if the bank discloses all their available mortgage products, a loan officer could still push borrowers toward a different product on the basis of race or other protected factors, which violates the Act.<\/p>\n<p>In 2019, Wells Fargo had to pay a <a href=\"https:\/\/www.americanbanker.com\/news\/wells-fargo-philadelphia-reach-settlement-in-redlining-lawsuit\">large settlement to the city of Philadelphia<\/a>. The city sued the lender, alleging that Wells Fargo steered black and Latinx borrowers into higher-cost or higher-risk loans, even when those borrowers had good credit or a financial profile that should have qualified them for a better loan. The practice contributed to <a href=\"https:\/\/www.inquirer.com\/opinion\/editorials\/wells-fargo-redlining-discrimantory-loans-predatory-philadlephia-editorial-20191227.html\">much higher foreclosure rates in minority neighborhoods<\/a>.<\/p>\n<p>The FHA also prohibits <a href=\"https:\/\/www.justice.gov\/crt\/fair-housing-act-1\">sexual harassment<\/a>, including quid pro quo activities such as requiring a borrower to engage in a sexual act to obtain housing or housing-related services (it can even apply to maintenance workers).<\/p>\n<p>The same protections apply in the secondary market, where loans are bought and sold after origination. If lenders were allowed to discriminate in the secondary market and could refuse to purchase a loan in (for example) a traditionally Black neighborhood, it would lower the loan\u2019s overall value to banks. That could, in turn, lead to a reluctance for lenders to grant loans that they can\u2019t resell, which would include all loans issued in that neighborhood.<\/p>\n<h3>Appraisal-related discrimination<\/h3>\n<p>If your home appraises for much less than expected, you could lose significant money in a sale. The Act bans <a href=\"https:\/\/www.homelight.com\/blog\/buyer-real-estate-appraisals-racism\/\">discrimination in appraising<\/a>, which happens when appraisers \u2014 often inadvertantly \u2014 assign lower values to Black-owned homes than to white-owned homes.<\/p>\n<p>Unfortunately, there has been some recent evidence that appraisal-related discrimination is still happening. <i>The New York Times<\/i> <a href=\"https:\/\/www.nytimes.com\/2020\/08\/25\/realestate\/blacks-minorities-appraisals-discrimination.html\">recently published an article<\/a> about one couple\u2019s experience having their home appraised in Jacksonville, Florida. The couple wanted to refinance their home. Based on nearby home value, they thought it should appraise at $450,000.<\/p>\n<p>Instead, their appraisal came in at $300,000. The wife, who is Black and owns the home, requested another appraisal. In the meantime, she removed all family photos, all books by Black authors, and only left Christmas cards from white families on display. Her white husband greeted the second appraiser at the door. For round two, the home appraised at $465,000.<\/p>\n<p>Appraisal discrimination is illegal, and one report in 2018 found that this devaluation still costs Black homeowners <a href=\"https:\/\/www.brookings.edu\/research\/devaluation-of-assets-in-black-neighborhoods\/\">$156 billion in cumulative losses<\/a>. This type of discrimination slows the growth of wealth in minority communities, preventing them from building equity and passing on that wealth to future generations.<\/p>\n<h3>Rental and sales discrimination<\/h3>\n<p>The Act also seeks to protect people from being discriminated against in the rental and sales market. Landlords cannot refuse to rent, and sellers cannot refuse to sell a house to someone based on the characteristics outlined in the FHA.<\/p>\n<p>For example, if you\u2019re making an offer on a house, the seller can\u2019t refuse to negotiate the sale based on your <a href=\"https:\/\/www.homelight.com\/blog\/buyer-racial-restrictive-covenants\/\">race<\/a>. They also can\u2019t impose a different price or set different terms.<\/p>\n<p>Landlords can\u2019t make housing unavailable to certain people, either by setting different terms or conditions or imposing different prices. This could include requiring a larger security deposit from an Asian renter, charging a higher rent for a similar unit to a woman (or a man!), or having a stricter late fee policy for a disabled renter. If any of a landlord\u2019s qualification or procedural criteria applies unequally, they could be engaging in illegal discriminatory behavior.<\/p>\n<p>An example can be found in one <a href=\"https:\/\/www.fairhousingcoach.com\/article\/seven-dc-re-firms-and-professionals-accused-housing-discrimination\">recent lawsuit<\/a> filed in Washington, D.C. The lawsuit alleges that, when talking with a prospective Black tenant, the landlord indicated a preference to rent to a white tenant. The landlord then failed to complete paperwork to help the Black tenant receive assistance with her security deposit, effectively preventing her from renting.<\/p>\n<p>Landlords also can\u2019t limit access to privileges, services, or facilities. The pool can\u2019t be closed to one group during certain hours; landlords or property managers can\u2019t limit access to the laundry room, and they can\u2019t only offer reserved parking to certain individuals. Principles of fairness must apply.<\/p>\n<p>These protections also extend to advertising and marketing a sale or rental. The home or apartment\u2019s listing can\u2019t have any indication of \u201cpreference, limitation, or discrimination\u201d in its wording. (This includes social media ads.)<\/p>\n<p>Agents have to be careful with a listing\u2019s wording, which can\u2019t discourage certain groups of people from purchase or rental. If a landlord says something like, \u201cOh, a nice single girl like you doesn\u2019t want to live in that neighborhood,\u201d this counts as <a href=\"https:\/\/www.homelight.com\/blog\/buyer-what-is-steering-in-real-estate\/\">steering a buyer away from an area<\/a>, and it\u2019s a violation of the law.<\/p>\n<p>Further, agents who try to persuade homeowners to sell based on the fear that neighborhood demographics are changing, which is called \u201cblockbusting,\u201d could lose their license.<\/p>\n<p>Finally, insurers must provide homeowners insurance to requesters, which can\u2019t be issued or priced based on the FHA characteristics.<\/p>\n<h3>For landlords specifically<\/h3>\n<p>Special provisions address <a href=\"https:\/\/www.homelight.com\/blog\/buyer-housing-discrimination\/\">landlords specifically.<\/a> Landlords cannot evict a tenant, or a tenant\u2019s guest, based on FHA characteristics. They can still evict tenants, but it must be on the basis of non-payment or other lease violations.<\/p>\n<p>Failing to make repairs, or delaying repairs, based on FHA characteristics is also illegal.<\/p>\n<p>Bergquist thinks that many landlords misunderstand the provisions that protect a renter\u2019s disability status. \u201cUnder the FHA, a person with a disability has a statutory right to request a physical modification to the home, assuming they have a disability-related need for it,\u201d she says. In other words, a landlord may have a legal obligation to make repairs or to remodel to accommodate the tenant.<\/p>\n<p>Even if they accept all applicants equally, landlords could inadvertently or deliberately engage in de facto segregation by assigning different groups of tenants to different buildings or sections within buildings.<\/p>\n<h3>For the industry at large<\/h3>\n<p>Harassment is illegal for everyone involved in the housing market, too! Agents cannot refuse to work with Black homebuyers. An agent who has strong religious beliefs cannot decline to show a house to someone of a different religion.<\/p>\n<p>Brokerage organizations and multiple listing services (MLSs) are also prohibited from denying access to or membership based on race.<\/p>\n<h2>Are there exceptions?<\/h2>\n<p>There are some exceptions to the Fair Housing Act.<\/p>\n<p><a href=\"https:\/\/www.homelight.com\/blog\/buyer-how-to-make-a-counter-offer-on-a-house-fsbo\/\">For sale by owner<\/a>, or FSBO rentals and sales, do not have to comply with the Fair Housing Act\u2019s rules. Housing operated by religious organizations is exempt, as are private clubs that limit occupancy.<\/p>\n<p><a href=\"https:\/\/www.homelight.com\/blog\/types-of-real-estate-investments\/\">Owner-occupied buildings<\/a> with no more than four units do not have to follow the Act\u2019s rules. If you\u2019re sharing a building with a landlord \u2014 they can legally discriminate against you.<\/p>\n<h2>How is the act enforced?<\/h2>\n<p>The Department of Housing and Urban Development (HUD) investigates discrimination claims and acts if it finds that the law has been violated. HUD is investigating the case of the Jacksonville family\u2019s lower appraisal referenced above.<\/p>\n<p>HUD also hires people to pose as renters or buyers to test whether any laws are being broken. These tests include sending pairs of buyers and renters, usually comprising white folks and BIPOC, to the same real estate brokerages or rental homes, noting if they are treated differently.<\/p>\n<p>HUD may also proactively pull data on home sales, mortgages, and lending practices in some neighborhoods to examine them for patterns that indicate discrimination. You should report the violation to HUD \u2014 but occasionally when state or local watchdogs get enough information about widespread discrimination, they can also take action.<\/p>\n<p>Lastly, you should <a href=\"https:\/\/www.hud.gov\/program_offices\/fair_housing_equal_opp\/online-complaint\">file a complaint through HUD<\/a>. HUD investigates complaints and helps enforce the law.<\/p>\n<h2>The Fair Housing Act and you<\/h2>\n<p>No matter your race, color, national origin, religion, sex, disability, or familial status \u2014 the Fair Housing Act protects you from receiving unfair treatment when you\u2019re buying, renting, or selling a home.<\/p>\n<p>Bergquist wishes that everyone knew there is no reason for property owners to discriminate. She points out that, \u201cthe factors that are most relevant\u2014ability to pay and tenant history\u2014are nondiscriminatory,\u201d and \u201cLandlords, home-sellers and agents<\/p>\n<p>who use nondiscriminatory screening criteria, will have a larger market of qualified candidates for their property.\u201d<\/p>\n<p>Knowing your rights before you start home or apartment shopping helps you relax and enjoy the experience.
