But that\u2019s not an objective figure understood by all parties. Rather, fair market value generally means the <a href=\"https:\/\/www.genesislawfirm.com\/your-right-to-just-compensation-when-the-government-takes-your-property-through-eminent-domain\">sale price that a willing and well-informed buyer would pay<\/a> to purchase the property on the open market. The amendment also grants property owners the right to challenge the legality of the seizure.<\/p>\n<p>\u201c\u2018Just compensation\u2019 is a fluid concept and depends on the art of valuation and the costs everyone will invest in litigating,\u201d shares <a href=\"https:\/\/www.rajehsaadeh.com\/\">Rajeh A. Saadeh<\/a>, a New Jersey-based real estate attorney, investor, professor, and an expert on the subject of eminent domain.<\/p>\n<h3>Public use<\/h3>\n<p>The government can only justify eminent domain if it is seizing private land for public use. Public use includes projects like roadways, bridges, public parks, buildings, schools, and facilities like water, power, and gas. The government may also <a href=\"https:\/\/www.law.cornell.edu\/constitution-conan\/article-1\/section-8\/clause-11-14\/eminent-domain\">employ eminent domain in wartime for defense reasons<\/a>.<\/p>\n<p>Beyond these purposes, public use remains a somewhat fluid concept that may apply to other government projects, as well. In a 2005 ruling, for instance, the Supreme Court ruled that <a href=\"https:\/\/www.house.leg.state.mn.us\/hrd\/pubs\/ss\/clssemntdom.pdf\">\u201cpublic use\u201d extends<\/a> to general benefits a community would enjoy from a boost in economic development. However, in 2006, the Minnesota state legislature enacted a law that prevented eminent domain seizures based on economic benefit alone.<\/p>\n<h2>Here\u2019s an overview of the eminent domain process<\/h2>\n<p>If you\u2019re the subject of eminent domain, here\u2019s a preview of the events to come:<\/p>\n<ol>\n<li>The <a href=\"https:\/\/eminentdomainlawcalifornia.com\/process\/\">government agency first inspects<\/a> the property to determine fair market value. <a href=\"https:\/\/www.hud.gov\/program_offices\/public_indian_housing\/centers\/sac\/eminent\">HUD guidance stipulates<\/a> that the fair market value \u201cshould be determined by an independent state-licensed or state-certified appraiser.\u201d As the homeowner, you will receive notice of the appraisal, so you or your real estate agent may accompany the appraiser while they evaluate your home.<\/li>\n<li>As the homeowner, <a href=\"https:\/\/www.youngmoorelaw.com\/blog\/3-dos-and-donts-if-your-property-is-subject-to-eminent-domain\/\">obtain a copy of the appraisal<\/a> so you can anticipate the government\u2019s offer and plan with your attorney accordingly.<\/li>\n<li>The government will make you an offer at or above the appraiser\u2019s assessed fair market value, typically <a href=\"https:\/\/search.usa.gov\/search?affiliate=housingandurbandevelopment&amp;affiliate=housingandurbandevelopment&amp;query=eminent+domain\">within 45 to 60 days<\/a> following the appraisal. The offer will include a &#8220;summary statement&#8221; explaining the basis for the offer.<\/li>\n<li>Once you receive the offer, you may negotiate with the agency until both parties reach a satisfactory agreement. You\u2019ll sign a purchase contract and receive payment at a mutually acceptable time.<\/li>\n<li>If you\u2019re unable to reach an agreement, the agency may file a lawsuit to acquire your property through an eminent domain proceeding in court. You have the right to receive notice of the proceeding and the right to a fair hearing before the award is made final. They&#8217;ll negotiate on your behalf to secure the best offer possible and represent you in court if both parties cannot reach an agreement.<\/p>\n<p>\u201cAlways negotiate with the government when you are in an eminent domain situation. Many individuals often forget that the government has a budget and could easily exceed a property\u2019s worth,\u201d advises Carlos Del Rio, a <a href=\"https:\/\/www.linkedin.com\/in\/carlos-del-rio-015b58a0\/\">real estate attorney in Chicago<\/a>.<\/p>\n<p>Here are some of the items your lawyer can help you negotiate:<\/p>\n<ul>\n<li>Selling price<\/li>\n<li>Timing<\/li>\n<li><a href=\"https:\/\/www.nc-eminent-domain.com\/challenging-eminent-domain\/eminent-domain-relocation-compensation\/\">Relocation expenses<\/a><\/li>\n<\/ul>\n<p>To negotiate the best price possible, you should also <a href=\"https:\/\/www.homelight.com\/find-real-estate-agents\">hire a top real estate agent<\/a> to help you identify your home\u2019s fair market value. Your agent will conduct a <a href=\"https:\/\/www.homelight.com\/blog\/comparative-market-analysis\/\">comparative market analysis<\/a>, which targets the value of your home by evaluating properties similar to it (these are called \u201ccomparables,\u201d or \u201ccomps\u201d for short). They can then <a href=\"https:\/\/appraisersblogs.com\/client-supplying-comparable-list\">provide these comps to the appraiser<\/a> to encourage a higher appraised value for your home.<\/p>\n<p>\u201cA real estate agent is a great investment here because they will know the current market and will know what homes are selling for based on the government&#8217;s recent investment in your neighborhood,\u201d Del Rio comments.<\/p>\n<h3>Weigh professional fees with the reward<\/h3>\n<p>On average, real estate attorneys charge between <a href=\"https:\/\/listwithclever.com\/real-estate-blog\/realtor-or-real-estate-lawyer-which-is-cheaper\/\">$150 to $350 per hour for their services<\/a>, though the cost may be higher depending on the attorney\u2019s experience. You\u2019ll need to weigh the cost of those fees against the potential payoff to determine if hiring an attorney is beneficial for your situation.<\/p>\n<p>In some cases, the cost is well worth the reward. However, the only way to pull off this feat is to prove the government does not plan to use your land for justified public use \u2014 an unlikely outcome.<\/p>\n<p>\u201cProvided that the government complied with procedural requirements to exercise the power of eminent domain, it is generally very difficult to overcome a claim that the taking is for public use,\u201d explains Saadeh.<\/p>\n<p>In layman&#8217;s terms, this means that the government needs to go through <a href=\"https:\/\/www.jimersonfirm.com\/blog\/2017\/03\/government-procedures-filing-eminent-domain-lawsuit\/\">layers of internal approval<\/a> to initiate the eminent domain process.
