But if you live in a non-disclosure state, you might search the web only to find inaccurate information \u2014 if there\u2019s any listed at all.<\/p>\n<p>Disclosure, in general, is important in real estate. State and federal laws require that <a href=\"https:\/\/www.homelight.com\/blog\/mandated-disclosures-real-estate\/\">sellers disclose<\/a> any lead paint, radon, asbestos, and other potential hazards on their property so that buyers are aware of any trouble spots. This differs from a non-disclosure state, however. In this context, \u201cnon-disclosure\u201d doesn\u2019t mean that you keep quiet about any roofing, termite, or other maintenance issues but that public records keep mum about your selling price.<\/p>\n<p>If you live in a non-disclosure state, it means that sale prices in a real estate transaction are not disclosed or recorded as public record. If you want to know the sale price of a home, you\u2019d have to ask the seller directly or work with a real estate professional who has access to the <a href=\"https:\/\/www.homelight.com\/blog\/buyer-what-is-the-mls-multiple-listing-service\/\">Multiple Listing Service (MLS)<\/a>. It offers privacy for buyers and sellers.<\/p>\n<p>\u201cNobody wants to disclose what they paid for [a house or other property],\u201d he says.<\/p>\n<p><a href=\"https:\/\/www.texasrealestate.com\/members\/posts\/what-non-disclosure-doesnt-mean-for-reporting-prices-to-the-mls\/\">Texas Realtors<\/a> (formerly the Texas Association of Realtors) notes that it\u2019s a common misconception that being a non-disclosure state means that a listing broker doesn\u2019t have to disclose their data to the MLS.<\/p>\n<p>The <a href=\"https:\/\/www.nar.realtor\/\">National Association of Realtors<\/a> (NAR) also says that non-disclosure states \u201c<a href=\"https:\/\/www.nar.realtor\/about-nar\/policies\/frequently-asked-questions-about-the-avm-sample-data-license-agreement\">cannot withhold sold data from MLS data feeds<\/a>.\u201d The restrictions on disclosing this data relate \u201conly to public display of that information,\u201d NAR explains on its website. \u201cParticipants can use sold data, in the same fashion that other data provided by the MLS is used, to develop estimates of value.\u201d<\/p>\n<p>Martinez says that potential sellers in a non-disclosure state shouldn\u2019t worry that they won\u2019t know what their house is worth, or that their agent won\u2019t be able to find details about the sales of comparable properties. The sellers can <a href=\"https:\/\/www.homelight.com\/blog\/how-to-get-a-home-appraisal\/\">undergo a home appraisal<\/a>. Plus, their agent can provide them with the relevant sale information.<\/p>\n<p>\u201cDisclosure is made public in the real estate community as we move forward with buyers and sellers when we\u2019re doing market analysis or buyer presentations to ensure that a price is not absolutely ridiculous,\u201d Martinez says. Nondisclosure is \u201cmore relevant in terms of property taxes,\u201d when a municipality wants to assess a home\u2019s value.<\/p>\n<div id=\"section--2\" data-toc-header=\"Why do some states practice non-disclosure?\" data-toc-type=\"head\"><\/div>\n<h2>Why do some states practice non-disclosure?<\/h2>\n<p>If you live in a state such as Florida, where you can look up any address through your county\u2019s property appraiser to see what a home is worth, the non-disclosure that Martinez describes may seem puzzling.<\/p>\n<p>The decision to enact non-disclosure laws often stems from a combination of privacy concerns, tax policies, and industry influence. While transparency in real estate transactions can benefit buyers, sellers, and investors, some states prioritize confidentiality for various reasons:<\/p>\n<h3>Privacy protections for property owners<\/h3>\n<p>Many homeowners prefer to keep their financial transactions private, especially high-net-worth individuals or those concerned about public exposure.<\/p>\n<p>Publicizing real estate sale prices can lead to unsolicited marketing, potential security risks, or even personal safety concerns for sellers.<\/p>\n<h3>Preventing tax assessments based on sale prices<\/h3>\n<p>In disclosure states, property taxes are often reassessed based on recent sales prices, which can cause fluctuations in property tax bills.<\/p>\n<p>Non-disclosure laws can stabilize property tax assessments by preventing county appraisers from using recent sale prices to adjust tax valuations. Instead, they rely on alternative valuation methods, such as property characteristics and historical data.<\/p>\n<h3>Influence from real estate and business interests<\/h3>\n<p>Some real estate professionals and investors advocate for non-disclosure laws to protect market advantages. If property sale prices are not public, agents and appraisers may have greater control over market data, making their expertise more valuable.<\/p>\n<p>Similarly, large institutional investors and developers may favor limited transparency to maintain negotiation leverage and keep strategic purchases discreet.<\/p>\n<h3>Tradition and state policy preferences<\/h3>\n<p>Some non-disclosure states have long-standing traditions of limited government intervention in private transactions.<\/p>\n<p>In states like Texas and Wyoming, where personal property rights are deeply valued, keeping real estate sales private aligns with broader political and economic philosophies.<\/p>\n<p>By understanding the motivations behind non-disclosure laws, buyers, sellers, and investors can navigate these markets more effectively, using alternative sources of property data when needed.<\/p>\n<p>As Daniel Gonzalez, director of legislative affairs for Texas Realtors, told <a href=\"https:\/\/www.texastribune.org\/2015\/09\/01\/election-lawsuit-could-upend-price-disclosure-deba\/\">The Wall Street Journal<\/a>: \u201cA private transaction between myself and you should be kept private. \u2026 We should not have to give the government any indication of what we\u2019re doing in our private lives.\u201d<\/p>\n<p>In addition to individual privacy concerns, another reason not to disclose is to maintain the \u201cproprietary information\u201d that the MLS collects, according to a document from the <a href=\"https:\/\/leg.mt.gov\/content\/Committees\/Interim\/2013-2014\/Revenue-and-Transportation\/Meetings\/July-2014\/DOR%20Report%20Update%20on%20Public%20Disclosure.pdf\">Montana Department of Revenue<\/a>.
