Reconveyance is the process of <a href=\"https:\/\/www.lawdepot.com\/law-library\/faq\/deed-of-reconveyance-faq-united-states\/#.YFpM0a9Khyw\">removing the lender\u2019s lien on the title of the property once the borrower (the homeowner) has paid the loan in full<\/a>.<\/p>\n<p>Whether you\u2019re <a href=\"https:\/\/www.homelight.com\/blog\/should-i-pay-off-mortgage\/\">paying off your mortgage<\/a> with home sale proceeds or other available funds, reconveyance is an essential step to cut ties with your lender. He advises sellers to start the reconveyance process early in a transaction to avoid unwelcome surprises and prevent delays.<\/p>\n<div id=\"section--1\" data-toc-header=\"What is reconveyance, and why do you need one?\" data-toc-type=\"head\"><\/div>\n<h2>What is reconveyance, and why do you need one?<\/h2>\n<p>When you first bought your home, you signed a <a href=\"https:\/\/www.chase.com\/personal\/mortgage\/education\/financing-a-home\/promissory-note\">promissory note<\/a> laying out your loan terms. Depending on your <a href=\"https:\/\/www.rocketlawyer.com\/article\/which-states-allow-deeds-of-trust.rl\">state law<\/a>, you also signed either a <a href=\"https:\/\/www.nolo.com\/legal-encyclopedia\/whats-the-difference-between-mortgage-deed-trust.html#:~:text=The%20two%20main%20differences%20between,process%20(but%20not%20always).\">mortgage or deed of trust<\/a>, an agreement to use your home as collateral for the loan.<\/p>\n<p>That agreement \u2014 the mortgage or deed of trust \u2014 is a legal record of the lien on your property. Your county or other local municipality\u2019s recorder\u2019s office retains a recorded copy of the document. If you were to stop making payments or otherwise default on the loan, that lien would give your lender the right to foreclose, and you could lose your home.<\/p>\n<p>When you satisfy the terms of your promissory note and pay off your loan, your lender no longer has claims to your property. Reconveyance is the process of <a href=\"https:\/\/www.lawdepot.com\/law-library\/faq\/deed-of-reconveyance-faq-united-states\/#.YFpM0a9Khyw\">removing the lender\u2019s lien from the property\u2019s title once the borrower has paid the loan in full<\/a>.<\/p>\n<p>The specific reconveyance document your lender uses to process the reconveyance hinges on whether your loan is secured by a mortgage or deed of trust.
