Joining is typically not optional, as the whole idea is to maintain a certain standard of care and upkeep with the involved homes \u2014 but HOAs are not uncommon, with <a href=\"https:\/\/foundation.caionline.org\/\">about 26%<\/a> of the United States population living in a community association area.<\/p>\n<p>Specifications for security measures, aesthetic regulations, community resources, and various other services are set forth and enforced by the HOA. We\u2019ll get more into what HOA dues cover shortly, but (ideally) everyone stands to benefit from the added value and structure of the association.<\/p>\n<h2>So: What are HOA dues, and what do they cover?<\/h2>\n<p>These are the fees that you \u2014 and every other homeowner in the neighborhood \u2014 are responsible for paying. Whether these are paid on a monthly, quarterly, or annual basis will depend on your specific HOA.<\/p>\n<p>HOA dues cover management, maintenance, and improvements around the community. These features will vary from one neighborhood to the next, but they typically include:<\/p>\n<ul>\n<li>Common area <a href=\"https:\/\/www.homelight.com\/blog\/is-landscaping-a-good-investment\/\">landscaping<\/a><\/li>\n<li>Common area utilities (electricity, water, and so on)<\/li>\n<li>Maintaining community amenities (pools, clubhouses, fitness centers, and others)<\/li>\n<li>Security<\/li>\n<li>Parking lot maintenance<\/li>\n<li>Trash removal<\/li>\n<li>Snow removal<\/li>\n<li>Staff<\/li>\n<li>Insurance policies<\/li>\n<li>&#8230; And any number of other incidentals that may be unique to your neighborhood or building<\/li>\n<\/ul>\n<p>Usually, the HOA will also maintain a reserve of funds for emergencies or major expenses. If you\u2019re looking at a modest <a href=\"https:\/\/www.homelight.com\/blog\/buyer-what-is-a-condo\/\">condo building<\/a>, where the amenities are limited to an elevator and a parking garage, your fees may well be along the lines of $200 per month. On the other hand, if the home you\u2019re eyeing is located in a sprawling gated community with a <a href=\"https:\/\/www.homelight.com\/blog\/pool-design-ideas\/\">pool<\/a>, common area clubhouse, and a fully equipped gym, you could be looking at closer to $1,000 each month for your HOA dues.<\/p>\n<p>HOA dues are usually paid along with your mortgage, but some associations may be set up for direct payments on a quarterly or annual basis. And there may be a further HOA buy-in fee due at the time of your home\u2019s purchase \u2014 which, you guessed it, will vary depending on your HOA\u2019s guidelines.<\/p>\n<p>Scramlin also warns that, \u201cjust because you\u2019re buying a home in an HOA doesn\u2019t mean you\u2019re automatically approved. Sometimes the association wants the buyer\u2019s information ahead of time so they can approve them.\u201d<\/p>\n<p>If the idea of having to be approved by the HOA makes you nervous, don\u2019t get too caught up on the what-ifs. The HOA board will have to evaluate your intent to purchase in accordance with the <a href=\"https:\/\/www.hud.gov\/program_offices\/fair_housing_equal_opp\/fair_housing_act_overview\">Fair Housing Act<\/a>, and if you\u2019ve been <a href=\"https:\/\/www.homelight.com\/blog\/home-financing\/mortgage-loans\/\">preapproved<\/a> for the mortgage amount you\u2019ll need to buy the home in question, there\u2019s little reason to deny your application.<\/p>\n<p>While it sounds like the variables are endless when it comes to HOA dues and regulations, the good news is that none of these details are kept secret until it\u2019s too late for you to back out. In essence, you (as the homebuyer) also must approve the HOA, which is why it&#8217;s important to <a href=\"https:\/\/www.homelight.com\/find-real-estate-agents\/buying\">work with a skilled agent<\/a> who is familiar with the communities in your area and can properly advise when you\u2019re considering a home under an HOA.<\/p>\n<p>If the CC&amp;Rs are not already provided with the <a href=\"https:\/\/www.homelight.com\/blog\/documents-needed-to-sell-house\/\">listing information<\/a>, it\u2019s critical that your agent request a copy early on in the purchase process.<\/p>\n<p>\u201cIt\u2019s always good to ask for a copy of the HOA CC&amp;Rs and handbook within two days of an accepted offer,\u201d says Scramlin.<\/p>\n<p>In a <a href=\"https:\/\/www.homelight.com\/blog\/sellers-vs-buyers-market\/\">competitive market<\/a> where sellers are receiving multiple offers and there\u2019s no time to spare, you may even want to ask for and review those HOA documents prior to <a href=\"https:\/\/www.homelight.com\/blog\/buyer-how-to-make-an-offer-on-a-house\/\">making an offer<\/a>. This way, you\u2019ll know exactly what you\u2019re potentially signing up for and can accurately determine if this home is, in fact, the one to pursue.<\/p>\n<h2>Can I opt out of paying HOA dues?<\/h2>\n<p>In short, no.<\/p>\n<p>By purchasing a home in an HOA, you are contractually obligated to pay all associated fees, and failure to do so could result in the HOA putting a lien on your home. In severe cases, <a href=\"https:\/\/www.homelight.com\/blog\/buyer-foreclosure-short-sale-bank-owned\/\">foreclosure<\/a> can even result from defaulting on your HOA payments.<\/p>\n<p>These associations are not something to take lightly, and <a href=\"https:\/\/www.homelight.com\/blog\/buyer-how-to-get-rid-of-an-hoa\/\">disbanding an HOA<\/a> is just shy of impossible. This could be anything from a pipe bursting in a common area to a video surveillance system suddenly shorting out. If you (or other residents) feel that an assessment has been leveled unjustly, there should be protocol in the CC&amp;Rs for filing a dispute.<\/p>\n<h2>How often can an HOA raise its dues?<\/h2>\n<p>Technically, an HOA can increase dues at any time. At the risk of sounding like a broken record, there should be verbiage on this in the CC&amp;Rs, but it\u2019s a good idea to inquire specifically about rate hikes before buying a home in an HOA if the terms aren\u2019t clearly spelled out in the documents.<\/p>\n<h2>Are HOA dues tax-deductible?<\/h2>\n<p>Though there are certain <a href=\"https:\/\/www.homelight.com\/blog\/making-offers\/legal-tax\/\">tax benefits<\/a> to owning a home, HOA fees are usually not part of the equation.<\/p>\n<p>According to H&amp;R Block, the <a href=\"https:\/\/www.hrblock.com\/tax-center\/filing\/adjustments-and-deductions\/deducting-hoa-fees\/#:~:text=If%20you%20purchase%20property%20as,you%20to%20deduct%20HOA%20fees.\">HOA dues for your primary residence are not tax-deductible<\/a>, but you can write off dues on investment properties.
