Moreover, probate sales of real estate can vary from state to state.<\/p>\n<p>And if you think all of this sounds complicated, you\u2019re right: Probate sales are often tricky, complex, and drawn-out transactions that can present additional challenges for a would-be buyer, but can often result in a <a href=\"https:\/\/www.homelight.com\/blog\/buyer-how-to-find-cheap-houses-to-buy\/\">significant bargain for the buyer<\/a>.<\/p>\n<p>In this expert-backed guide, we\u2019ll answer some of the most common questions about probate sales to help demystify this type of transaction so you can determine whether it\u2019s right for you.<\/p>\n<h2><div id=\"section--1\" data-toc-header=\"What is a probate sale?\" data-toc-type=\"head\"><\/div>What is a probate sale?<\/h2>\n<p>Let\u2019s start with the fundamentals. Again, \u201cprobate\u201d refers to the legal process by which a court determines the validity of a will and how any property in the will is to be distributed.<\/p>\n<p>People prepare wills to specify what they would like to happen to their property after they die. Even if no one contests what is dictated in a will, a will must generally be approved by a probate court to ensure outstanding creditors or other claimants have an opportunity to collect any debts from the deceased\u2019s estate before ownership is transferred.<\/p>\n<p>It\u2019s also important to note that the need to go through probate and the court\u2019s involvement is almost always triggered when someone dies without a will (also known as dying intestate) and has left behind substantial personal or real property.<\/p>\n<p>An actual \u201cprobate sale\u201d can arise or be ordered by the court when the property owner passes while still owing substantial debts, and it is determined that the property needs to be sold to <a href=\"https:\/\/www.homelight.com\/blog\/sell-house-pay-off-debt\/\">cover those outstanding debts<\/a>.<\/p>\n<p>To complete the probate process involved with these sales, a designated representative or attorney will likely need to be appointed to actually sell the property, with the heirs to then receive any <a href=\"https:\/\/www.homelight.com\/blog\/sellers-net-sheet\/\">net proceeds from the sale<\/a>.<\/p>\n<p>Something to keep in mind: the whole probate process can be long and complex given that it is all overseen by the court, and any sale must be approved by court order.<\/p>\n<p>That is, \u201c[w]ith a probate sale, you need a court order \u2014 you can\u2019t just have a buyer and seller agreeing,\u201d says <a href=\"https:\/\/www.homelight.com\/agents\/mark-moskowitz-ca-01128018\">Mark Moskowitz<\/a>, a top-selling Agoura Hills, <a href=\"https:\/\/www.homelight.com\/los-angeles-ca\/top-real-estate-agents?Page=1\">Los Angeles agent<\/a> who has over three decades of real estate experience. \u201cYou have a third party, and any time you have a third party, it takes longer and can be complicated.\u201d (More on these complexities later.)<\/p>\n<h2><div id=\"section--2\" data-toc-header=\"How does a probate sale unfold?\" data-toc-type=\"head\"><\/div>How does a probate sale unfold?<\/h2>\n<p>A probate sale can be complicated and take time. Spoiler: If you\u2019re interested in pursuing such a property, bring your patience and make sure you have a place to live in the meantime.<\/p>\n<p>This is what the <a href=\"https:\/\/www.homelight.com\/blog\/what-happens-to-a-house-in-probate\/\">probate process<\/a> tends to look like in a chronological timeline:<\/p>\n<ul>\n<li aria-level=\"1\">The <a href=\"https:\/\/www.homelight.com\/blog\/how-does-an-executor-sell-a-house\/\">probate court appoints an executor<\/a> or administrator.<\/li>\n<li aria-level=\"1\">The executor hires a <a href=\"https:\/\/www.homelight.com\/blog\/probate-real-estate-agent\/\">real estate agent<\/a>.<\/li>\n<li aria-level=\"1\">The executor will <a href=\"https:\/\/www.homelight.com\/blog\/home-appraisal-process\/\">get the house appraised<\/a> and work to <a href=\"https:\/\/www.homelight.com\/blog\/how-to-set-list-price\/\">set a sale price<\/a>, which is sometimes determined by the court.<\/li>\n<li aria-level=\"1\">The home is listed for sale.<\/li>\n<li aria-level=\"1\">Buyers can make offers, which usually have to include a 10% <a href=\"https:\/\/www.homelight.com\/blog\/buyer-what-is-a-down-payment\/\">down payment<\/a>. This will be returned if the buyer does not win the bid.<\/li>\n<li aria-level=\"1\">The court decides whether to accept the offer. During this stage, family members of the deceased must be given the opportunity to comment on the terms of the home\u2019s sale and, as such, must receive sufficient notice of the same. If the offer is accepted, a court date is then typically set for 30 to 45 days in the future for the court to formally approve and confirm the sale.<\/li>\n<li aria-level=\"1\">During this time, other buyers can <a href=\"https:\/\/www.homelight.com\/blog\/buyer-how-to-make-an-offer-on-a-house\/\">make higher offers<\/a>, which can be somewhat tricky for buyers, as the executor or other appointed representative of the state has a duty to obtain the best result for the estate.<br \/>\n\u201cLet\u2019s say you want to buy a probate, and they\u2019re asking $600,000 for it. You make an offer for $575,000, and they accept it,\u201d explains Moskowitz. \u201cBut now when they go to court, people can overbid you. If that happens, you would have to pay more to get the property.\u201d<\/li>\n<li aria-level=\"1\">On the court confirmation date, all interested buyers must attend the hearing. The house is then <a href=\"https:\/\/www.homelight.com\/blog\/selling-a-home-at-auction\/\">sold at auction<\/a> to the highest bidder, and the executor then signs a contract with the buyer.<\/li>\n<li aria-level=\"1\">Any <a href=\"https:\/\/www.homelight.com\/blog\/how-home-inspection-works\/\">home inspections<\/a> can be done at this point. In this section, we\u2019ll explore its key advantages, from scoring below-market prices to discovering historic homes with character.<\/p>\n<h3>You may capitalize on the below-market price<\/h3>\n<p>The main benefit to a buyer of buying a probate sale is that you might get a house at a lower price, as the <a href=\"https:\/\/www.homelight.com\/blog\/buyer-what-is-buying-a-home-as-is\/\">property itself can be dilapidated<\/a>. But even this isn\u2019t a guarantee, as you might have competition during the court process from buyers who didn\u2019t make the initial strongest offer, but who jump in and drive up the price when it\u2019s possible to submit an overbid.<\/p>\n<p>Consider one of Moskowitz\u2019s recent sales as an example of how this scenario often plays out in the real world: \u201cThe last one we did, the father was extremely ill, and nothing had been upgraded in the house. The pool was green. They were avid smokers, so the walls were yellow. It showed poorly, but the price was really low because of that.\u201d<\/p>\n<p>After an offer was made, \u201csure enough, we [still] had a lot of overbids, especially from contractors that were hoping to flip the deal,\u201d he explains.<\/p>\n<h3>You can secure a home amid the tight housing market<\/h3>\n<p>Probate sales represent the possibility that a buyer might find inventory not otherwise available to them.<\/p>\n<p>Many would-be buyers are daunted by the prospect of probates, which narrows the field of competition. According to Moskowitz, there\u2019s usually a little bit better value for people willing to take a risk with the protracted timeframe and the as-is nature of the sale.<\/p>\n<p>An as-is probate sale represents unknowns, he says. \u201cSo, if you\u2019re willing to go through the process, you\u2019re getting a little better deal.\u201d<\/p>\n<p>Consider this real-world example, he says: \u201cIf two houses were identical side-by-side and one was a probate, and you had to go through this process, whereas the other you can look up [on the MLS] and have an easy process, you\u2019re not going to pay the same amount of money. So you\u2019ll [likely] end up getting a discount on the probate property.\u201d<\/p>\n<p>Many buyers are keen to turn over every stone to find any property that suits their needs. And probate sales provide a separate channel to explore when inventory is slim.<\/p>\n<p>\u201cIn this market, we have got to look at probate, look at bankruptcy,\u201d Moskowitz says. \u201cWe look at everything to get a house.\u201d<\/p>\n<h3>You can get your hands on a unique property<\/h3>\n<p>Aside from offering additional options amid the limited housing inventory, probate sales can be a great way to find unique or historic homes that you wouldn&#8217;t usually see on the market. Many of these properties have been in the same family for years, and they often haven\u2019t been listed for sale in a long time.<\/p>\n<p>This means you could come across a home with interesting architecture, history, or character that\u2019s hard to find in newer properties. If you&#8217;re after something special or looking for a home with potential, probate sales can give you access to some truly one-of-a-kind options. The process can be slower than traditional sales, and there may be unexpected legal hurdles or complications. Before diving into a probate sale, be aware of these potential disadvantages.<\/p>\n<h3>You may face a long sale process<\/h3>\n<p>These sales can take a long time, sometimes even years. And that\u2019s not just a matter of patience, but certainly a practical issue for a buyer, too.<\/p>\n<p>\u201cYou have to have a place you can stay in the meantime. If you have time on your side, it can be a good deal,\u201d Moskowitz says.<\/p>\n<p>But on the flip side, \u201cIf you\u2019re in a rental and you\u2019re being kicked out, it\u2019s probably not the right way to go. You\u2019re going to be homeless before you get the process completed.\u201d<\/p>\n<p>The delay also means that sometimes you can\u2019t lock in a loan long enough to cover the whole probate timeline. \u201cYou\u2019re locked in for 30 days or 45 days, and we don\u2019t know if we can close in that time, so what if interest rates go up a little bit in this market?\u201d Moskowitz says. \u201cThat\u2019s the risk of dealing with courts and overbids and time constraints.\u201d<\/p>\n<h3>You could get a property with a lot of issues<\/h3>\n<p>Probates are <a href=\"https:\/\/www.homelight.com\/blog\/how-to-sell-a-house-as-is\/\">sold as-is<\/a>. This increases risks for the buyer.<\/p>\n<p>\u201cIt\u2019s really important to go slow and get as much information about the house as possible because a lot of times on probate the heirs didn\u2019t live in the area. They don\u2019t live in the house. They\u2019re not going to [be able to] give you some of the disclosures,\u201d Moskowitz says.<\/p>\n<p>\u201cSo it\u2019s almost like a foreclosure in the sense that you don\u2019t get any additional information. And it\u2019s \u2018buyer beware.\u2019 There\u2019s more risk of hidden things that we don\u2019t know about.<\/p>\n<p>\u201cYou don\u2019t know about disclosures, you don\u2019t know about the condition of the property,\u201d Moskowitz adds. And that\u2019s why buyers will want to look for a discounted price point in order to make it worth their while.<\/p>\n<p>\u201cHow hot the market is at that time will determine the discount you get on a probate,\u201d and if you don\u2019t feel like you\u2019re getting much of a deal compared with a typical listing, it just might not be worth it, he says.<\/p>\n<h3>You likely need to invest in updates and repairs<\/h3>\n<p>For many people, this represents an opportunity and a benefit, not a drawback. But this won\u2019t be the case for every buyer.<\/p>\n<p>\u201cSometimes you can get a better deal as the homes may be a little bit distressed as the person who was older hasn\u2019t fixed it up,\u201d Moskowitz says. \u201cIt\u2019s usually a little bit more of a fixer-upper in that it could be very dated: You walk in, and it looks straight out of 1970 or 1980, and they haven\u2019t done any updates.\u201d<\/p>\n<h3>You often can\u2019t include contingencies<\/h3>\n<p>With typical listings, <a href=\"https:\/\/www.homelight.com\/blog\/what-does-contingent-mean-in-real-estate\/\">contingencies<\/a> can be a way to get a seller to wait for you to secure your financing or sell your existing house. Without contingencies, you won\u2019t have any such leeway.<\/p>\n<h3>You may go through a tough search process<\/h3>\n<p>Probate properties just aren\u2019t as easy to find as other types of sales. You can find them on the <a href=\"https:\/\/www.homelight.com\/blog\/what-is-the-mls\/\">multiple listing service (MLS)<\/a>, but finding probate sales often requires extra legwork \u2014 even contacting your local probate court, seeking home auctions in your area, or scouring newspapers and publications. For some buyers, that\u2019s just too daunting a proposition.<\/p>\n<h3>You may encounter legal issues with the title<\/h3>\n<p>Maybe the heirs are fighting as to what happens to the property when their loved one died without a will. No matter how you slice it, there\u2019s just a lot of red tape. Even a traditional home transaction has tons of paperwork and legal hurdles. With a probate sale, it\u2019s magnified.<\/p>\n<p>That\u2019s why, Moskowitz says, \u201cthe attorney that\u2019s handling it becomes very important. You have to file things in a proper manner. All the paperwork has to be filed and approved. If you\u2019re not doing it properly, then the judge will disallow it, and it adds to the process.\u201d<\/p>\n<p>In one recent experience Mokowitz had with a probate sale, a surviving spouse wanted to <a href=\"https:\/\/www.homelight.com\/blog\/need-to-sell-my-house-fast\/\">sell the home quickly<\/a>. In a hot market, it sold right away. However, COVID-19 and other factors slowed the availability of a death certificate, a document necessary to close, which significantly delayed finalizing the transaction.<\/p>\n<h3>Sometimes, you might not even get a bargain with a probate<\/h3>\n<p>\u201cThe differential may not be as great between the open-market value of the house and the deal you might otherwise be able to get with a probate sale right now,\u201d Moskowitz explains.<\/p>\n<p>\u201cPeople may actually bid up the probate a little bit higher now just to get into a house.\u201d Whereas in a more typical market, you could \u201cdefinitely see probate sales going for less money and being a better value just for the hassles required to get one.\u201d<\/p>\n<h2><div id=\"section--5\" data-toc-header=\"Navigating probate real estate complexities with ease\" data-toc-type=\"head\"><\/div>Navigating probate real estate complexities with ease<\/h2>\n<p>A probate sale involves selling a deceased person&#8217;s property through the court to settle their estate.
