The significance of that $1, however, is mostly symbolic. They can simply give you the house outright and it will carry the same tax and ownership implications, says <a href=\"https:\/\/prescottlawoffices.com\/robert-s-pecharich\/\">Robert S. Pecharich<\/a>, a real estate attorney and senior partner with <a href=\"https:\/\/prescottlawoffices.com\/\">Boyle, Pecharich, Cline, Whittington &amp; Stallings P.L.L.C.<\/a> in Prescott, Arizona.<\/p>\n<p>\u201cEither way, [the parents] are making a gift,\u201d Pecharich says. He adds that some people might believe that selling a property for $1 means there is consideration involved and the transaction is binding. However, you can transfer property either as a complete gift or for a nominal amount like $1, and both methods are legally valid.<\/p>\n<p>The only time that $1 might be necessary is if a fiduciary arrangement, such as a trust, requires it, says <a href=\"https:\/\/www.homelight.com\/agents\/rick-ruiz-nv-54121\">Rick Ruiz<\/a>, a top-selling real estate agent in Las Vegas, Nevada, who sells properties 46% quicker than the average Las Vegas agent.<\/p>\n<p>\u201cRhetoric in the trust may mandate that anything has to be sold and can\u2019t be gifted,\u201d Ruiz says. \u201cBut at the end of the day, what [the parents] are really doing is giving you the property.\u201d<\/p>\n<p>According to the IRS, if you transfer money or property to someone without receiving full value in return, it is considered a gift. The value of that gift must be reported using a gift tax return, <a href=\"https:\/\/www.irs.gov\/forms-pubs\/about-form-709\">IRS Form 709<\/a>. This doesn\u2019t necessarily mean you owe any taxes on that gift, however.<\/p>\n<p>Here are some key points and helpful tips to consider when gifting property:<\/p>\n<ul>\n<li aria-level=\"1\"><strong>Gift tax annual exclusion: <\/strong>The <a href=\"https:\/\/www.irs.gov\/businesses\/small-businesses-self-employed\/frequently-asked-questions-on-gift-taxes#:~:text=The%20annual%20exclusion%20for%202014,the%20annual%20exclusion%20is%20%2416%2C000.\">annual federal gift tax exclusion<\/a> for 2024 is $18,000 for single filers and $36,000 for married couples filing jointly. For 2025, this goes up to $19,000 for single filers and $38,000 for married couples filing jointly. Meaning, you can individually give up to $19,000 to as many people as you want in 2025 without having to report it to the IRS. Spouses who combine their gift exclusion (known as \u201c<a href=\"https:\/\/www.irs.gov\/instructions\/i709#en_US_2021_publink16784xd0e1517\">gift splitting<\/a>\u201c) must still file a gift tax return, but it won\u2019t affect their lifetime gift tax exemption unless it exceeds the $38,000 threshold.<\/li>\n<li aria-level=\"1\"><strong>Lifetime gift tax exemption:<\/strong> Under the current federal law, the <a href=\"https:\/\/smartasset.com\/estate-planning\/gift-tax-explained-2021-exemption-and-rates#:~:text=Lifetime%20IRS%20Gift%20Tax%20Exemption\">lifetime gift tax exemption<\/a> is $13.99 million. This means someone can give away up to that amount in their lifetime before having to pay any gift tax. Assuming no changes, this exemption amount is set to expire at the end of 2025. Starting January 1, 2026, the exemption will drop to about <a href=\"https:\/\/aslcpa.com\/estate-gift-tax-exemption-amount-2025\/\">$6.2 million<\/a>.<\/li>\n<li aria-level=\"1\"><strong>Gift letter:<\/strong> To properly give a gift of equity, the seller should draft and sign a <a href=\"https:\/\/fastercapital.com\/content\/Gift-Letters--A-Key-Component-in-Real-Estate-Transactions.html\">gift letter<\/a> listing all pertinent information regarding the gift. The letter should include the seller\u2019s relationship to the buyer, the property\u2019s address, and the amount of equity being gifted.<\/li>\n<li aria-level=\"1\"><strong>Follow IRS Rules:<\/strong> You will need to be extra careful with how you handle the entire transaction. You\u2019ll want to take steps to prevent the appearance of impropriety when the IRS reviews the transaction.<\/li>\n<\/ul>\n<p><strong>Example:<\/strong><\/p>\n<p>Let\u2019s say Linda wants to sell her home to her son, Robert, for $1. Linda gets the home appraised and it\u2019s valued at about $400,000. To make sure everything is handled correctly, she hires a real estate agent to manage the paperwork. They then sign a purchase agreement, run a <a href=\"https:\/\/www.homelight.com\/blog\/buyer-what-is-a-property-title-search\/\">title search<\/a> to make sure the title is clean, and close the sale.<\/p>\n<p>When tax season rolls around, Linda reports a gift of $399,999 to the IRS. Assuming she has never declared a gift before, that amount is subtracted from the full $13.99 million lifetime gift tax exemption ($13,990,000 \u2013 $399,999 = $13,590,001).
