If you don\u2019t know what you want, the line disappears too quickly. Well, that angst multiplies 10 times when committing to a home purchase, and you\u2019ll need extra time (and extra details) to feel confident in your decision. Just like you do about that oat milk latte.<\/p>\n<p>Before inspections, you may fear the state of the home or the seller\u2019s willingness to negotiate repairs if the home needs serious work. In the state of Texas, an \u201coption period\u201d allows a buyer to get these details before making the final choice. It means you can back out of the purchase <a href=\"https:\/\/www.trec.texas.gov\/article\/how-deal-inspection-reports-provided-seller\">if you\u2019ve discovered something ugly<\/a> or move forward with a home that\u2019s been held for you during your decision-making. Keep in mind that option periods are specific to Texas and other states will have different processes that give buyers the time they need to make the final decision.<\/p>\n<p>We researched the details and talked with an expert Texas real estate agent to help you make the most of an option period.<\/p>\n<div id=\"section--1\" data-toc-header=\"What is an option period?\" data-toc-type=\"head\"><\/div>\n<h2>What is an option period?<\/h2>\n<p>An option period is a portion of time, <a href=\"https:\/\/www.tsahc.org\/homebuyers-renters\/step-6\">agreed upon between buyer and seller<\/a>, which permits the buyer to think on a purchase decision. This enables the buyer to <a href=\"https:\/\/www.recenter.tamu.edu\/articles\/tierra-grande\/Hot-Market-Cool-Practices-2313\">terminate the sale at any point during the allotted time<\/a>. \u201cAny reason is valid to change your mind during an option period \u2026 the only thing we\u2019re risking is our option fee,\u201d shares real estate agent <a href=\"https:\/\/www.homelight.com\/agents\/jennifer-bacak-tx-696685\">Jennifer Bacak<\/a>, who sells homes 47% faster than the average agent in <a href=\"https:\/\/www.homelight.com\/bryan-tx\/top-real-estate-agents\">Bryan,Texas<\/a>.<\/p>\n<p>You may be unfamiliar with the term option period, which is understandable as the phrase is specific to the <a href=\"https:\/\/www.homelight.com\/states\/tx\">Lone Star State<\/a>. However, other regions have similar processes that support the buyer\u2019s decision. For example, states such as <a href=\"https:\/\/bulletins.ncrec.gov\/due-diligence-questions-and-answers\/\">North Carolina<\/a> and <a href=\"https:\/\/georgiatitle.com\/Buyer-Property-Guidance\/Due-Diligence-Period\/index.html#:~:text=In%20Georgia%2C%20it%20has%20become,in%20forfeiture%20of%20earnest%20money.\">Georgia<\/a> have a due diligence period that works in a similar way.<\/p>\n<div id=\"section--2\" data-toc-header=\"When does an option period begin?\" data-toc-type=\"head\"><\/div>\n<h2>When does an option period begin?<\/h2>\n<p>The option period and fee are finalized in the <a href=\"https:\/\/www.homelight.com\/blog\/buyer-real-estate-contract\/\">purchase contract<\/a> terms of the sale. A higher fee and shorter time frame might make the buyer\u2019s offer more attractive to the seller, and sellers may ask for <a href=\"https:\/\/www.recenter.tamu.edu\/articles\/tierra-grande\/Hot-Market-Cool-Practices-2313\">better terms<\/a> which could extend the negotiation period.<\/p>\n<p>The option period begins the day after the contract is signed, and both buyer and seller are contractually obligated to carry out those terms. The home will revert to \u201coption pending\u201d on the market and sellers can only accept backup offers during this time.<\/p>\n<div id=\"section--3\" data-toc-header=\"How much is a typical option period fee? Is this refundable?\" data-toc-type=\"head\"><\/div>\n<h2>How much is a typical option period fee? Is this refundable?<\/h2>\n<p>An option period usually comes at the cost of a non-refundable option fee on the buyer\u2019s side. A typical fee ranges between <a href=\"https:\/\/closeconcierge.io\/what-is-an-option-fee-in-real-estate\/\">$100 and $500+<\/a>, determined by the market and negotiated terms, and <a href=\"https:\/\/www.trec.texas.gov\/article\/changes-delivery-option-fee-0\">is due three days<\/a> after the contract\u2019s start date.<\/p>\n<p>This fee makes the option period more worth a seller&#8217;s time. But don\u2019t be confused \u2013 the fee is also a win for buyers whether or not they back out!<\/p>\n<p>\u201cThe earnest money and the option fee are credited to you at closing,\u201d explains Bacak for buyers who move forward. But for those who terminate, they only lose the option fee. The buyer would still receive back the earnest money deposit (EMD) placed down at signing, usually between <a href=\"https:\/\/www.homelight.com\/blog\/how-to-protect-earnest-money\/\">1% and 3%<\/a> of the sale price.<\/p>\n<p>If the buyer decides to back out of the sale after the option period because of a low appraisal (and the lender will not lend what is needed to purchase the property) or a financing issue, and the appraisal and financing contingencies have not been released, the buyer will still lose the option fee, but will be refunded their earnest money deposit. Financing contingencies and appraisal contingencies are separate from the option period \u2014 but the only way for a buyer to get the option fee returned to them, is if they close the sale, according to Bacak.<\/p>\n<div id=\"section--4\" data-toc-header=\"How long is a typical option period? Can it be extended for any reason?<\/h2>\n<p>A typical option period is anywhere between <a href=\"https:\/\/legacytexastitle.com\/option-period\/\">1 and 10 days<\/a> but is dependent on several factors. These factors include:<\/p>\n<ul>\n<li>Final negotiated terms between buyer and seller<\/li>\n<li>Conditions of the market (<a href=\"https:\/\/www.homelight.com\/blog\/sellers-vs-buyers-market\/\">buyer\u2019s market versus seller\u2019s market<\/a>)<\/li>\n<li><a href=\"https:\/\/www.homelight.com\/blog\/buyer-home-inspection-checklist\/\">Type of inspections<\/a> needed for the buyer to do their due diligence<\/li>\n<\/ul>\n<p>The greatest determiner of the option period and fee is market status \u2014 a buyer might need to aim for a shorter option period in a seller&#8217;s market. \u201c$500 for five days has become my go-to when I\u2019m competing with other contracts and low inventory,\u201d Bacak explains. <a href=\"https:\/\/www.homelight.com\/find-real-estate-agents\/buying\">Finding a buyer\u2019s agent<\/a> like Bacak will help you navigate these waters to make an attractive offer that also gives you the time you need to make your decision.<\/p>\n<p>An option period <a href=\"https:\/\/www.texasrealestate.com\/members\/posts\/how-to-extend-an-option-period\/\">can be extended<\/a> if the seller agrees. Having a strong case for extension, such as needing additional time for a specialty inspection, is a good negotiation tool. But be warned: Every option period and extension comes at a price. You can use these findings to renegotiate terms, such as if the home needs a new septic system or roof.<\/li>\n<li><b>Specialty inspections<\/b>: Speaking of inspections, another option period to-do is to order any specialty inspections that the property may need. <a href=\"https:\/\/www.homelight.com\/blog\/buyer-types-of-home-inspections\/\">Examples include<\/a> HVAC system, chimney, or mold inspections. \u201cWood destroying insect inspections are crucial to Texas properties too,\u201d states Bacak.<\/li>\n<li><b>Attorney reviews<\/b>: Maybe you want an attorney to review the contract before you take any leaps. This is not always necessary but a smart move, especially for those who are completely unaware of how the <a href=\"https:\/\/www.homelight.com\/blog\/buyer-steps-to-buying-a-house\/\">homebuying process<\/a> works.<\/li>\n<\/ul>\n<p>\u201cYou can skip the option period, and that\u2019s another way to make your offer appealing. But that gives me pause as an agent because it\u2019s very risky,\u201d Bacak shares. Will this affect my offer being accepted by a seller?<\/h2>\n<p>An option period favors the buyer much more than the seller. This is because it offers the buyers the security of being able to back out after signing the purchase contract. In a seller\u2019s market, offers with option periods might lack a bit of appeal to a seller with a lot of interested buyers.<\/p>\n<p>Texas\u2019s option period is <a href=\"https:\/\/www.trec.texas.gov\/i%E2%80%99m-buying-house-do-i-have-have-pay-option-period-be-able-buy-house\">not mandatory<\/a> and could affect a buyer\u2019s offer being accepted as the seller could view it as inconvenient. A seller with multiple offers wants the best price in the shortest amount of time.<\/p>\n<p>However, this doesn\u2019t spell the end of your dream home journey. Utilize an agent\u2019s expertise in negotiation, offer a short option period, and up your option fee. Bacak explains, \u201cThe more option money you put down, the better as it shows the seller you&#8217;re invested and won\u2019t terminate.\u201d<\/p>\n<div id=\"section--7\" data-toc-header=\"What happens if I decide to back out during the option period? \" data-toc-type=\"head\"><\/div>\n<h2>What happens if I decide to back out during the option period?<\/h2>\n<p>An option period means the buyer can terminate the contract during the agreed-upon time frame without any particular reason being given.
