In addition, federal law mandates the <a href=\"https:\/\/www.epa.gov\/lead\/real-estate-disclosures-about-potential-lead-hazards\">disclosure of lead-based paint<\/a> for houses built before 1978 to reduce the risk of lead poisoning that may cause neurological damage in young children.<\/p>\n<div id=\"section--2\" data-toc-header=\"Is a seller\u2019s disclosure form required in Utah?\" data-toc-type=\"head\"><\/div>\n<h2>Is a seller\u2019s disclosure form required in Utah?<\/h2>\n<p>Although statutory law in Utah only mandates telling potential buyers if the house has been <a href=\"https:\/\/le.utah.gov\/xcode\/Title57\/Chapter27\/57-27.html?v=C57-27_1800010118000101\">contaminated from the use, storage, or manufacture of methamphetamines<\/a>, that\u2019s not all you\u2019ll have to divulge.<\/p>\n<p>Utah is what\u2019s known as a <a href=\"https:\/\/www.homelight.com\/blog\/buyer-beware-caveat-emptor\/\">\u201cCaveat Emptor\u201d or \u201cbuyer beware\u201d<\/a> state, which means it\u2019s ultimately the buyer\u2019s responsibility to determine if the home they are purchasing has any issues. However, as the seller, you must also disclose known defects adversely affecting the property\u2019s use and value that a buyer could not discover by a <a href=\"https:\/\/www.homelight.com\/blog\/how-home-inspection-works\/\">reasonable inspection<\/a>, according to <a href=\"https:\/\/law.justia.com\/cases\/utah\/supreme-court\/2001\/mitchell.html\">a ruling by Utah\u2019s Supreme Court<\/a>.<\/p>\n<p>\u201cIn the world of real estate, it\u2019s such a big asset and expense that a buyer is purchasing that a seller is required or obligated to tell them everything they know about the property so the buyer can go into it with full disclosure,\u201d says <a href=\"https:\/\/www.homelight.com\/agents\/joel-carson-ut-hl1424268\">Joel Carson<\/a>, an award-winning real estate agent in Salt Lake City with over 35 years of experience. Buyers need to know what they\u2019re getting and not discover major detrimental issues after the sale that are expensive to fix, like a sinkhole or a <a href=\"https:\/\/www.homelight.com\/blog\/selling-a-house-with-foundation-issues\/\">foundation<\/a> that\u2019s been moving.<\/p>\n<p>\u201cA seller needs to give that information to the buyer so they can make a decision on how they want to proceed,\u201d says Carson.<\/p>\n<p>Seller disclosure forms are legal documents, so take them seriously. By bringing issues to the buyer\u2019s attention prior to closing, you\u2019ll lessen the risk of a lawsuit if defects are found after the sale goes through.<\/p>\n<p>While you\u2019re not expected to be aware of every single issue your home might have or reveal problems you know nothing about, being dishonest about known material defects or not disclosing them could be an act of <a href=\"https:\/\/www.law.cornell.edu\/wex\/fraudulent_concealment\">fraudulent concealment or fraudulent nondisclosure<\/a>.<\/p>\n<p>For example, claiming you\u2019ve never repaired your roof when you replaced a few shingles due to leaks could be considered an act of fraud. You might be accused of fraudulent nondisclosure by untruthfully stating that you haven\u2019t detected any leaks in the roof.<\/p>\n<p>\u201cThe seller could be sued for fraud if the buyer could prove that they knew something and didn\u2019t disclose it,\u201d says Carson. If the buyer discovers a geological report that wasn\u2019t disclosed, the seller could end up in court.<\/p>\n<p>If you have any questions about filling out a disclosure form, ask your <a href=\"https:\/\/www.homelight.com\/find-real-estate-agents\">real estate agent<\/a> or consult a real estate attorney. Remember, honesty is the best policy for a smooth sales transaction without exposing you to legal liability and monetary damages.<\/p>\n<div id=\"section--5\" data-toc-header=\"What does a seller\u2019s disclosure not do?\" data-toc-type=\"head\"><\/div>\n<h2>What does a seller\u2019s disclosure not do?<\/h2>\n<p>The home may have hidden problems, such as <a href=\"https:\/\/www.homelight.com\/blog\/selling-a-house-with-mold\/\">mold<\/a> in the attic or <a href=\"https:\/\/www.homelight.com\/blog\/how-much-is-a-termite-inspection\/\">termites in the crawl space<\/a>, so the disclosure form won\u2019t reveal issues unknown to the seller. Nor does the disclosure require the seller to conduct a thorough examination of the property or to fix anything that\u2019s been disclosed. But if you opt for a <a href=\"https:\/\/www.homelight.com\/blog\/pre-listing-home-inspection\/\">pre-listing inspection<\/a>, you will have to be upfront about all defects the inspector finds.<\/p>\n<p>\u201cA lot of sellers are not aware of the little detailed items that inspectors find,\u201d says Carson. He explains that it would be difficult to prove that sellers knew something they didn\u2019t disclose, like a cracked sewer line, which wouldn\u2019t be discovered unless the sewer line was scoped.<\/p>\n<p>Although it\u2019s a legal document, there\u2019s no guarantee that the seller hasn\u2019t omitted any issues or provided misleading information. Thus, buyers shouldn\u2019t rely solely on the disclosure form, but obtain a <a href=\"https:\/\/www.homelight.com\/blog\/free-home-inspection\/\">professional home inspection<\/a> to get an accurate
