This helps the buyer make an informed decision, and it helps the seller meet their legal requirements and protect themselves from any future liability.<\/p>\n<p>\u201cHere\u2019s the way I see it: Property disclosures are a wonderful tool to protect both sides,\u201d Niakan explains.<\/p>\n<p>For example, a buyer might come into a home with a stain on the ceiling \u2014 and panic. \u201cThey say, <em>what\u2019s that stain? What\u2019s going on?<\/em> It creates a question mark in the buyer\u2019s eyes.\u201d<\/p>\n<p>With the disclosure form, that problem is solved. \u201cIt\u2019ll explain everything the seller knows about the house. So, in this case, it could be a leak that happened six months ago, and they fixed it, but the stain is still there.\u201d He says that can make both the buyer more comfortable and keep the seller from assuming liability.<\/p>\n<h3>What does a Florida disclosure form mean for sellers?<\/h3>\n<p>The purpose of the disclosure form is to make known what you know. That protects you from liability.<\/p>\n<p>\u201cThe seller is protecting themself by disclosing what they know.\u201d That way, he says, if the buyer has a problem after closing, it was either already disclosed, or the seller has made it clear that they weren\u2019t aware of the issue.<\/p>\n<p>\u201cEither way, it means the seller has already done their part.\u201d<\/p>\n<div id=\"section--2\" data-toc-header=\"What does a Florida disclosure form mean for buyers?\" data-toc-type=\"head\"><\/div>\n<h2>What does a Florida disclosure form mean for buyers?<\/h2>\n<p>Disclosures aren\u2019t just there to shield sellers from legal responsibility. For the buyer, the disclosure serves its own very important purpose. \u201cThe buyer is protected by being informed of historical facts,\u201d Niakan says.<\/p>\n<p>For instance, he gives the example of a leak in the home. \u201cKnowing what\u2019s occurred in the past helps them understand what they\u2019re buying into. It protects the buyer,\u201d he says, and helps them predict any future issues.<\/p>\n<section class=\"building-block bb-type-default bb-agent-quote bg-none\" id=\"bb-1\"><div class=\"body block\"><div class=\"container-fluid\"><div class=\"block-content\">            <blockquote class=\"post-blockquote\">\n                <q>So, let\u2019s go back to square one: There\u2019s no obligation for the seller to fill out a property disclosure form. property.\u201d<\/p>\n<p>In Florida, a <a href=\"https:\/\/www.unlimitedmls.com\/forms\/Property-Disclosure-Form.pdf\">seller\u2019s property disclosure form isn\u2019t required<\/a> by law. However, Florida law still requires that home sellers and their real estate agents disclose any significant defects with the property, such as cracks and other foundational issues.<\/p>\n<div id=\"section--4\" data-toc-header=\"What doesn\u2019t a seller\u2019s disclosure not do?\" data-toc-type=\"head\"><\/div>\n<h2>What doesn\u2019t a seller\u2019s disclosure not do?<\/h2>\n<p>A seller\u2019s disclosure does not mean that everything about the house is accounted for and disclosed.<\/p>\n<p>\u201cSellers don\u2019t need to know anything,\u201d Niakan points out. He gives the example of a seller selling their rental property. \u201cA seller could have bought a property, never lived in it, and had a tenant at it the whole time. The tenant never told them of any issues. The tenant solved all the problems themselves that came up.\u201d<\/p>\n<p>When it\u2019s <a href=\"https:\/\/www.homelight.com\/blog\/best-time-to-sell-a-house-in-florida\/\">time to sell<\/a>, they wouldn\u2019t necessarily ever have learned about these material facts. \u201cThen the owner would never have known one thing wrong with the property. And when it\u2019s time to disclose, they could say I don\u2019t know to absolutely everything \u2014 and it would still be okay. Because, in fact, they don\u2019t know anything.\u201d<\/p>\n<div id=\"section--5\" data-toc-header=\"When is the Florida disclosure form required to be submitted?\" data-toc-type=\"head\"><\/div>\n<h2>When is the Florida disclosure form required to be submitted?<\/h2>\n<p>In Florida, a seller is required to disclose any known <a href=\"https:\/\/www.lawpensacola.com\/blog\/2026\/01\/what-defects-must-a-seller-legally-disclose-to-buyers-in-florida\/\">material defects<\/a> prior to closing. Beyond that, when the disclosure form comes into play is individual to each deal.<\/p>\n<p>Some listing agents have preferences for how their clients handle the selling disclosure. The timing of when you fill out the disclosure form can play into your selling strategy. It can even help you close a deal sooner.<\/p>\n<p>\u201cA lot of listing agents try to get that property disclosure from the seller upfront and attach it to the <a href=\"https:\/\/www.homelight.com\/blog\/what-is-the-mls\/\">MLS<\/a> listing,\u201d Niakan says. \u201cThat\u2019s a very thorough, clean, good way to do it.\u201d<\/p>\n<p>Consider this: When you disclose any significant material defects upfront, the buyers you attract will be fully aware of your home\u2019s imperfections. That can help you avoid a scenario where a buyer is very interested, puts in an offer, and then backs out later when they learn that the <a href=\"https:\/\/www.homelight.com\/blog\/selling-a-house-with-foundation-issues\/\">foundation is settling<\/a>, for example.<\/p>\n<p>Ultimately, no home is perfect, so letting buyers know what they\u2019re getting into upfront is a strong way to weed out those who aren\u2019t \u201cthe one\u201d and find your true prospects.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Ready to sell a home in Florida?
