These risks include: earthquakes, tornados, landslides, wildfires, volcanoes, hurricanes, tsunamis, and other <a href=\"https:\/\/www.usgs.gov\/faq\/natural-hazards\">natural disasters<\/a>.<\/p>\n<h3>What is the Natural Hazard Disclosure Report (NHD)?<\/h3>\n<p>The <a href=\"https:\/\/www.car.org\/-\/media\/CAR\/Documents\/Transaction-Center\/PDF\/QUICK-GUIDES\/Quick-Guide--Natural-Hazard-Disclsoure-NHD-Statement-REVISED-52022.pdf\">Natural Hazard Disclosure Report<\/a> (NHD) is a California-specific report that home sellers must complete for their buyers in order to sell a home in a natural hazard zone. So we all use third-party companies.\u201d<\/p>\n<p>This puts any liability for incorrect information on the third-party company who provides you with the report, rather than on you.<\/p>\n<h3>What does the NHD require you to disclose?<\/h3>\n<p>There are <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?sectionNum=1103.2.lawCode=CIV\">six main natural hazards<\/a> that must be disclosed in California\u2019s NHD report. They are:<\/p>\n<ul>\n<li aria-level=\"1\">Special flood zone areas<\/li>\n<li aria-level=\"1\">Area of potential flooding on a dam failure inundation map<\/li>\n<li aria-level=\"1\">Very high fire severity zone<\/li>\n<li aria-level=\"1\">Wildland areas with substantial forest fire risks<\/li>\n<li aria-level=\"1\">Earthquake fault zone<\/li>\n<li aria-level=\"1\">Seismic hazard zone<\/li>\n<\/ul>\n<p>But that\u2019s not all that\u2019s in there. The NHD is an extensive report that covers a wide array of potential hazards beyond the main natural hazards, like homes located in flood zones or on earthquake fault lines.<\/p>\n<p>\u201cIt&#8217;s about 43 to about 60 pages long,\u201d explains McCaslin-Curtis. \u201cThe NHD also covers radon gas, airports, and any industrial hazard within a mile radius of your home. It also talks about if the home has special tax assessment rates, which are known as <a href=\"https:\/\/www.clta.org\/consumer7.html\">Mello-Roos<\/a>.\u201d<\/p>\n<h3>What are your options if your home is in a natural hazard zone?<\/h3>\n<p>There is only one option if you want to sell your home and you know that it lies in a natural hazard zone \u2014 you must disclose this information.<\/p>\n<p>Not doing so can put you in legal jeopardy if you knowingly sell a home without disclosing all of the natural hazard risks. That\u2019s why it\u2019s so important to get the NHD report from a third-party company. Most of these companies offer order forms for NHD reports on their websites and cost between <a href=\"https:\/\/nhd.report\/compare-NHD-report-companies\">$50 to $150<\/a>, depending on where the property is located and the length of the report.<\/p>\n<p>However, these companies are not all created equal. Some might have a slow turnaround, a reputation for inaccuracies, or worse.<\/p>\n<p>Your best bet is to ask your <a href=\"https:\/\/www.homelight.com\/find-real-estate-agents\">experienced real estate agent<\/a> to help so that you\u2019re sure to get a reliable report in a timely manner.<\/p>\n<p>\u201cAs soon as we open up escrow on a listing, we order the NHD,\u201d assures McCaslin-Curtis. \u201cThe seller is the one that usually pays for that as part of their disclosure packet. It costs $99, and it takes about 48 hours to get it.\u201d<\/p>\n<p>Asking your agent to assist with the NHD report is the smart move because some sellers may be exempt from needing an NHD. While rare, your agent is in the best position to know if you qualify for an exemption.<\/p>\n<h3>Is California the only state that requires NHD?<\/h3>\n<p>Since the Natural Hazard Disclosure Act is a California state law, it is the <a href=\"https:\/\/www.snapnhd.com\/blog\/why-california-is-the-only-state-in-america-that-requires-an-nhd-report\">only state<\/a> that requires the NHDS from home sellers. Therefore it is the only state where there are companies that specifically produce NHD reports.<\/p>\n<p>That doesn\u2019t mean non-California residents are off the hook for disclosing natural hazard zones, though.<\/p>\n<p>Every state has some form of <a href=\"https:\/\/www.homelight.com\/blog\/mandated-disclosures-real-estate\/\">real estate disclosure laws<\/a> \u2014 and if that state has natural hazard zones, it likely has a law that requires you to disclose it to your sellers. This is especially true if you live in one of the <a href=\"https:\/\/www.usnews.com\/news\/best-states\/slideshows\/the-most-disaster-prone-states-in-the-us\">top 10 natural disaster states<\/a>.<\/p>\n<p>To be on the safe side, ask your agent about your state\u2019s requirements for natural hazard disclosures, and any official natural hazard reports you may need to order as part of your home sale.<\/p>\n<h2>What are the risks to homes built in natural hazard zones?<\/h2>\n<p>Whether you\u2019re selling a home in a natural hazard zone in California or another state with natural disaster risks, disclosing this isn\u2019t just about protecting you from liability.<\/p>\n<p>Disclosing natural hazards provides your buyers with vital information about how to properly protect their new home from those specific hazards. They should also check out their state\u2019s <a href=\"https:\/\/damsafety.org\/states\">dam safety program<\/a> and find out if they are required to have an <a href=\"https:\/\/damsafety.org\/dam-owners\/emergency-action-planning\">emergency action plan<\/a> in place.<\/p>\n<div id=\"section--3\" data-toc-header=\"Very high fire hazard severity zone\" data-toc-type=\"head\"><\/div>\n<h3>Very high fire hazard severity zone<\/h3>\n<p>The very high fire hazard severity zone is a California-specific designation that is addressed by the NHD report. With increased wildfires caused by climate change, some large insurance companies have <a href=\"https:\/\/apnews.com\/article\/california-wildfire-insurance-e31bef0ed7eeddcde096a5b8f2c1768f\">pulled back from California\u2019s home insurance marketplace<\/a>, saying that rising construction costs have pressed them to stop writing new policies in the state.<\/p>\n<p>The new owners also need to know that any remodeling projects they\u2019re planning may require <a href=\"https:\/\/www.dgs.ca.gov\/BSC\/Resources\/2022-Title-24-California-Code-Changes\/Part-2-Chapter-7A-Materials-and-Construction-Methods\">ignition-resistant construction<\/a>.<\/p>\n<div id=\"section--4\" data-toc-header=\"Wildfire hazard zone\" data-toc-type=\"head\"><\/div>\n<h3>Wildfire hazard zone<\/h3>\n<p>California isn\u2019t the only state at <a href=\"https:\/\/www.usgs.gov\/centers\/forest-and-rangeland-ecosystem-science-center\/news\/usgs-launches-wildland-fire-trends-tool\">risk for wildfires<\/a>. That\u2019s why the Forest Service of the U.S. Department of Agriculture creates the <a href=\"https:\/\/data.nal.usda.gov\/dataset\/wildfire-hazard-potential-whp-conterminous-united-states-270-m-grid-version-2018-continuous-2nd-edition\">Wildfire Hazard Potential<\/a> (WHP) report.<\/p>\n<p>For some, standard <a href=\"https:\/\/www.homelight.com\/blog\/buyer-what-does-fire-insurance-cover\/\">home insurance<\/a> may cover your house and belongings damaged by wildfire \u2014 but not always. In fact, you may be surprised to find your state highlighted on the <a href=\"https:\/\/www.usgs.gov\/natural-hazards\/earthquake-hazards\">earthquake hazard<\/a> map. There\u2019s even a <a href=\"https:\/\/www.nehrp.gov\/\">National Earthquake Hazard Reduction Program<\/a> (NEHRP).<\/p>\n<p>California does have some specific earthquake-related designations that are covered in the NHD, though.
