  • Kellie and I connected, but did no business

Kellie Batali is knowingly misrepresenting the square footage of a home, and, when I emailed her about it, she responded by blasting personal accusations and derogatory comments against me, never once denying (or addressing) the fact that she misrepresented the home's data. Her misrepresentation over-inflated the price of the home by $88,709, overstated the finished square footage by 400 square feet, was damaging to the home values in the area whose data is accurately reported, and, of course, would be a deceptive tactic to use on any potential buyer. Because of the fact that I live in the neighborhood (I own more than one home here), I brought this to her attention anonymously, not wanting any blow-back as the messenger. She lived down to my concern. It was only when I threatened to file a formal complaint that Kellie quietly adjusted the square footage on the listing, although it is still overstated by 31 square feet, equating to an over-inflation of the price by $7068. It's now just the degree of fraud that she is knowingly perpetrating against the potential buyer. I emailed Kellie once to advise her of the issue and told her it was the only time I would be contacting her about it, however, she then responded with hostile, personal accusations, insisting that I call her with "the truth" and explain why I had picked "this *one* home" to get "so fired up" about. This, of course, makes me wonder about her other listings and how factually represented they are. She has represented a large portion of home sales in my area, and many of her listings have languished, sometimes for years, sometimes left to fall into foreclosure after becoming a blight on the neighborhood. I responded to Kellie's email to reiterate the facts, and to be clear this was only about the facts. I copied the owner of her branch, Shane Davies, on my response because he, too, could be held responsible for falsified information in a real estate transaction. I know that, if I were him, I would want to know what my broker was doing. He responded in like with Kellie, insinuating this was a personal issue that *I* had, and, for some reason, he felt we needed to talk about it. In one breath, he pushed for me to "come meet with [him] in person and describe [my] concerns." I had been quite succinct in stating my "concerns" and have absolutely no need to waste more of my time. In the next breath, he said, "You have decided to involve me in this discussion and I don't shy away easily." He then threatened me with "harassment" if I chose to communicate again while remaining anonymous, stating he would "involve [his] legal team to take appropriate action." This Windermere branch, and this Windermere broker, are knowingly operating outside of "good faith" real estate practices, and score *SUB-ZERO* in their people skills. I'll likely go forward with filing a formal complaint as they are knowingly continuing forward with falsified home data, as well as behaving toward me in a threatening and abusive manner.
