Our lease officially ended on 5/31/18. At 5:30pm, we completed a walk-through with property manager, Wilson Huang. Wilson noted that the oven wasn't cleaned and carpet on the 3rd floor (uninhabited space - had not been re-cleaned). Wilson threatened to with-hold our $2200 security deposit for these 2 very minor things. We pointed out the fact that aside from overlooking cleaning the oven, the property was left in better condition than when we moved in. Wilson informed us that he would NOT provide a move-out inspection checklist or findings; but instead - would allow the new tenants to determine our "damage" based on their inspection checklist when they move in. We noted that this was subjective and that as the property manager, he needed to assess the condition and make the determination. He refused. We asked him if he with-held money from the tenants before us based on our inspection checklist - he confirmed that he did. We pointed out that he made NO repairs based on our checklist and therefore unlawfully retained their security deposit (without making any repairs). We further explained that the turning over a property is a part of the landlord's duties, not the tenants; and that we had, in fact, left the property better than we found it and deserved a full refund of our security deposit. When we emailed the landlord (Song Chang, who's in China), Wilson changed his story and said "he couldn't complete the walk-through because we had the lights turned off". Although Duke Power turned the power off earlier in the day than we expected, it was daylight and there was complete and ample lighting that allowed Wilson to complete a FULL walk-through and make the determinations he made which were: 1) the oven was inadvertently missed during cleaning and 2) we didn't have the uninhabited 3rd floor carpet re-cleaned. We suspect that Wilson and CHK engages in unethical practices of retaining security deposits without basis and merit.
